Need advice *accident*
well if u have to fix ur car have her insurance company fix it. i had a high school chick ran into my car and cracked my ricy bumper before, and i made her pay for it. regardless if shes hot or not. i love my car more then a high school chick. lol
This accident is pretty straight foreward when it comes to an insurance claim. 1) you were going straight, at the speed limit.. 2) she was merging lanes.. so that putts the blame squarely on her.
anyway, i'm glad no one was severely hurt. Also, it sounds like the insurance will have no problem fixing your car. a little wheel and fender damage is something they handle all the time..

Dude.. If you didnt give YOUR vehicle info and drivers license info to the police officer on scene, then you are not listed on the report. Now, if you try to make a claim to her insurance company, they will tell you to go pound sand... And I can garantee that the police report will not be re-written at this point.. You can either get her to give you some cash, take her to small claims court, or go through your own insurance company, and eat the $500 deductible..

i'm starting to worry about this because i was just talking to people who were at a local auto-x today, and she was telling them that all she remembers is seeing my HIDs before changing lanes. i think she might be trying to imply that it was my fault the accident happened.. but like i said before, i was obviously ahead of her and in the lane when she hit my rear wheel/bumper
i want her or her insurance to fix my car, and the last thing i want to happen is have her insurance try and make my insurance pay for it. my insurance is pretty low as my record besides a ticket 2 years ago is practically spotless.. and i really dont want it to go skyhigh because of this
i feel like such an a-hole for thinking this way

An Evo is fast, but no car is faster at accelerating than at braking. I always love those commericals where a modern American muscle car floors it to free itself from two semis coming together but it isn't a realistic assumption. Next time hit the brakes, let her in and for now, especially if she doesn't have full insurance, eat the $500 deductible. It shouldn't break the bank, especially if you are driving a $30,000+ auto.

either way if the her or your insurnace find you at fault they still will give you point, hence making your monthly go up,....but if your not at fualt your insurance fixes the car and your rates stay the same (Since its not your fualt) ......trust me on this my best friends wife works at an Insurance agency...and I have gon through this before......so get it to your INSURANCE ASAP...or you will miss out and really pay out of pocket..
I hope this doesn't get ugly for you. Did the police take a statement from you? I see you've said you weren't on the accident report so probably not.
Did your other friend see what was going on? Atleast he would be a neutral witness if your female friend tries to make it out to be your fault.
Either way your insurance will probably go up, unless you can prove she is totally at fault.
Good luck, glad no one was hurt.

First, as Google said, always brake if you can do so without screwing someone behind you or losing control.
Second, let your insurance company sort it out. That's their job. The only other alternative is to avoid filing a claim altogether.

First, tell your insurance company everything in detail what happened. They will ask you if you had any police there at the scene or any police report and any witnesses at the scene. If you do, they will ask there name and contact info. (Insurance will call them and ask the witness exactly what happended) Then, tell them your situation exactly what happen that there were no police at the scene and you were so worry about your friend....
Now, insurance will give you claim number about this case. Or at least, tell you what to do exactly now on.......
If I was in your position right now.....I would pay $500 deductible and fix your car faster "only" because I know in fact that this case its "NOT" your fault by reading your story. You got rear ended, that tells it all. So, your point will not go up. And second, she's your friend and not stranger, so you wont be feeling like a--hole like you said before.
(NOTE: you can totally let her insurance to pay everything if it's her fault but it will take long time to fix your car. Its totally up to you.)

A few more cents from my perspective...
I wouldn't shell out any money if you're planning on pursuing the claim with her insurance company. As a rule I simply do not shell out money in a situation like this unless I am prepared to never recover the funds. I'd be making the repair once the insurance company check is in hand.
Clearly she'll be making a claim with her insurance company. Her insurance is going up no matter what and I doubt that the addtional $1500 or however much damage you have to your car will make any difference in the end.

Its amazing how little people know about the insurance contracts they sign...
AFAIK, your state is an At-Fault insurance state. What that means is that if the accident was deemed to be her fault 100%, her insurance company will indemnify (make whole again) all parties/property involved. She does not have a deductible to cover other people or other people's property, but she will have a deductible on her own vehicle. YOU NEED TO CALL HER INSURANCE COMPANY AND FILE THE CLAIM IMMEDIATELY. Don't mess with your own insurance company unless you want a claim guaranteed on your record even though the accident was not your fault. As soon as your own insurance company gets hold of any of this information and has someone do even the most minute of investigations on the accident, you will have a not-at-fault claim on your record for a minimum of 3 years, most likely for 5 years.
Now for the part of this story that really troubles me...
Probably every cop in the world starts out as a traffic cop. These guys might be jerkoffs usually, but they know how to work an accident scene. If you were involved in the accident, or witnessed the accident and stuck around for the cops to get there, SOMEONE WOULD HAVE TAKEN YOUR INFORMATION AND A STATEMENT FROM YOU. You saying that you were directly involved in the accident, but no one took any information from you or even really talked to you makes your entire story sound like one big stinky pile of BS. You either need to go to the doctor because you hit your head harder than you think, or you need to give us the straight story if you want accurate advice.
Enough wisdom from me for now, one hell of a first post if I do say so myself.
