I see your point in being concerned, I don't think it's unreasonable as long as they were "testing" it for the issue before and after. The only reason why we as consumers are paranoid is because of the "bad" places/stories we have heard of places joyriding to lunch or wherever.... and sometimes even screwing something up with the car. I have read many stories on bike forums of police calling the consumer letting them know the service/mechanic was speeding/wheeling and got a ticket....

I don't think it's much to worry about. Especially if your dealership works the way mine does.
I mean you have to figure that the service manger takes it out to verify the problem. He may take the tech for a ride to show him what the complaint is or the the tech may take it for a drive to see the severity of the problem. Then he does the reapair, takes it out to verify that it is fixed. Which should only take one try but you never know. Then the service manger probably takes it out to double check the mechanics work before they return it to you and you complain it isn't fixed.
Each could be around ten miles round trip and you're at 40 miles right there. Not to mention they may have to drive the car for a while to get everything up to operating temps.

Come on people, 40 miles is ridiculous. That means someone was out for probably a good 30-45 mins. Now as to whether you have any recourse, of course not.
On a side-note, one of my best friend's used to own an RX7 that he took to the dealer for some work. One day while driving home from work, I see his car, sunroof open, stereo blaring, weaving in and out of traffic and driving like a maniac. I finally managed to catch up to him at a light only to see a mechanic in the car smoking a cigarette. And of course when the light turned green, guess who left a nice 10' rubber stripe on the pavement.

40 miles is indeed ridiculous, on my first oil change at mitsu one of the mechanics there took a test drive in my evo without asking, that was like 5 miles on my car and i didnt like it at all, im very sensitive about other people drivin my car, especially some badass wonnabe mechanic with sunglasses and chewing gum

You obviously have never been a mechanic.. If you are please let me know where you work so you never work on my car!!.. I grew up with a family that owns car dealerships and any mechanic that would fix this problem and just shift it into fifth gear once and call it good would be an idiot. You would need to drive the car in 5th for a while and shift it in and out of 5th several times..

40 miles is excessive. Something to worry about, no. You can glorify it as a legit test drive by a very concerned mechanic, but last I have seen was that mechanics are on "Book Time", a near hour test drive is a near hour of no pay.
Well, a few years back I had some body work done to my Acura Integra and when I came to pick up the car I found a piece of paper in the back seat with everyones lunch orders.... them bums!!!

That would be too much for me! If the car comes back with the problem fixed, and there doesn't seem to be anything else wrong, like the tech messing with your stuff, I think I could live with it. I would always be wondering what they did during that 40 miles though. I would question them about what they did and why it was driven 40 miles.
