yea what kind of whinnig noise is it ??i have one in first gear when i lift up the gas pedal it whines but just on first gear and it has done it since new!

My car whines, so did my last 3 DSMs. It's called AWD, they all do it in one form or another. I like the whine myself, makes it seem like I have a killer dog box under the hood

my 04 had 3 broken transfer cases and now i have a brand new evo 9!! thanks to lemon law...look into it

the noise is apparent in all gears...40 mph....60mph....then ul be like holy **** at 80mph on the freeway... then when ur coming to a stop and throw it to neutral you can hear it winding down all the way to a stop...i took one of the service reps out (he owns an evo) and he was like oh...****....yeah ok we'll take a look at it...and they blamed that i put the wrong fluid...BUT they were the last ones to touch my fluids...

so if you think its the driver just shut up...

Not sure who to contact for the lemon law thing.. But what kind of oils have you been using for your tranny or tcase? For the hell of it, try putting some Royal Purple in there..
But id still rather go for the lemon law thing..

each state is different, but if your car has been in the shop for 2 consecutive weeks for the same problem and it still hasdnt been fixed or if the problem has not been fixed after 3 or 4 tries you can use the lemon law. your car came with a booklet on who to contact if this happens. good luck, i would give them back the car...

Mine is the same way...it is I believe a 2003 "thing".
I plan to pull mine soon and send it to SHep or TRE..get it done right and be DONE w/ it.

Mines been replaced 2 times and pulled to fix 2 leaks as well.SO thats a total of 4 removals and 2 TC's.Mitsu Stripped the Tie rod bolt its been pulled so many times.

TRE and SHep will put an End to all tyour Tcase worries as well as Handle anything you can put to it!

Even my 06 whines... my '02 325xi (AWD) did the same thing. It even gives off some backlash vibes when I lift high in the powerband. What's the problem?

My sister had an '01 VW Passat that was constantly having electrical problems. Basically it was like an EMP went off. It could happen anytime. The scariest is when it happened on the freeway or at night. No more power brakes, power steering or headlights. Every time she took it into the dealer it was another random excuse...you didn't have a VW battery, the alternator was bad, the airbag seal was wet, etc. They were making things up to avoid fixing the problem. I went with her once because she was so frsustrated that she was in tears. I told the service manager this is the last time we're bringing it in for electrical problems. When it happened again 3 weeks later I went with her back to the dealership again. He said he was gonna call VW North America and have them sound out a specialist. I told him free rental while we're waiting and when he said no way I said we'll see you in court. Three months later my sister got a check from VW for $40k. That covered the entire loan (with interest), lost wages, repair work, and rental cars charges. When she had finally had enough she started at that same website I linked above. Good luck. Nobody is gonna take care of this problem for you.

My sister drives a modded STi and they dont care about her mods. The new STi is deff my next car...sorry mitsubishi... you just tore my dreams up..... sorry for the rant...please dont flame me...if u were in my situation, u would to
trade it in for an evo 9

apparently this isn't a normal whine, he said he's driven other Evos and they don't whine like this. It's apparently abnormally loud or something above 80mph.

OP - I don't understand why you are on your 4th+ transfer case. Was it becuase they keep failing mechanciaclly? Or was it replaced repeatedly just because it was noisey?

Lemon Laws apply to cars that suffer failures that make them undrivable - Like the Passat story Turd Squirter descibed. The Lemon Law does not apply to Noise/Virbration/Harshness issues.

Why did you replace the TC for the first time? I am just curious. Did it go, or was it just making noise? I was just trying to make sense of what you were saying.
