dunno what your quesiton is but..... what do u want to happen?

the insurance company will likely give u a check for the value of the car and junk the car.... 90% is extremley high

The car was repaired but I am pissed that it was repaired when it should have been totalled. I do not think the insurance should be able to screw a person like this and was wondering if there was any litigation I could go through to get it totalled.

I thought at 75% it was totaled? If that is true then it should have been totaled either way. I would definatly fight for it, should be some one in the insurance company that is "higher up" as one would say.

Good luck with that tho.

this just doesn't sound right, it would have been totaled even at 24k of damage I would think, especially if the airbags deployed

are you saying that your insurer took your car and just decided to fix it for you? how long did they have your car for and didnt you keep in touch with your estimator and insurer? 90% is a lot to repair and your evo will never be the same again no matter how well they patch it up. they cant just decide to do work on your car without your consent, in this case you wanted to claim the title as totaled so your insurance still has to pay you.

you need to call your state's insurance oversite/regulation office (sorry but I forget the exact name)- each large city should have an office. You might have to look under government services in the phone book or call your agent or another agent. The state guy will tell you your state's regs on this. I believe in my state, TN, at 75% repair cost vs book value the car HAS to be totalled by law. I would be surprised if it is over 75% in your state. I had a similar problem like yours 5 yrs ago and once I got the state ins rep involved things changed immediately in my favor- which I'm sure was just a coincidence.
