First BS ticket on my evo!

Got pulled over last week for a BS reason (do not have my head light turned on during cloudy day) . Gonna do a Trial By declaration to fight for it . I am wondering how many of you autually used Trial By declaration to beat the case?

Isn't the law if you have your wipers on you must have your headlights on?

The cloudy day thing sounds like one confused cop unless it was raining.

See this is one case that confuses me. Is it a law in your state that declares you must have your headlights on during a cloudy day? If so and you didn't how can you fight it?

In my state you must have your headlights on if your windsheild wipers are on. Sooo, If I didn't have my headlights on while my wipers were running during a slight drizzle, I would be at fault...It 's the law. Please explain your situation a little better. Good Luck anyway.

I forget the exact vehicle code for the charge (don’t have the ticket with me I will go look it up) but I think the citation is something like do not turn on the head light during low visibility condition. Trial By Declaration is going to work? This is my first time to try Trial By Declaration and wonder the success rate for TBD

The cop is just trying to find a reason to pull over so that's why he gave you the BS ticket about having your headlights on, on a cloudy day which is foul!

Unless it was raining, fog, or dusk/night its just stupid to get a ticket for that. You probably will have to explain in court and likely will need a weather report.

OMG. That has the be the biggest BS reason for getting pulled over! If that isn't, who has been pulled over for an even bigger BS reason?

I had a cop pull me over for saying I had a bunch of aftermarket parts because he heard my stock bov and turbo on a cold day. Of course when he pointed to the stock upper intercooler piping saying that was aftermarket, I knew he didn't know crap!

Unless it was a very low visibility time in which case that could definitely cause big problems.
