Trial by declaration rocks. I have won several speeding tickets that way. Definitely the way to go. In California, if you lose by declaration, you can get a whole new trial afterwards. No downside if you're a decent writer.

that sucks good luck with it, thats as bad as when i got pulled over in my old evo 8 for not turning my highbeams off within 500 ft. of a cop, when the second i saw his headlights coming around the bend i turned mine off, some cops look for anything to pull you over especially in a nice car

I guess depending on where you were it might be a county or city thing. I always enjoy looking on the websites which list the most stupid laws from each state by city/county. I usually just leave my lights on all the time. When I head to work it is dark and when I come home(in winter) its getting dark or raining. I love it that the lights just shut off when you get out.

If you don't mind me asking, how much was the ticket for? If it is a real law, it is pretty funny. How is one to know if it is cloudy or partly cloudy? Too bad you have to waist your time getting this solved. Anyways, hope it all goes well.

Im thinkin there's something missing. First off, what was the weather REALLY like? Rain and/or fog? Also, what time? It gets dark earlier so if you're driving at 430-445p you need to have your lights on. I HIGHLY doubt he pulled you over at 12noon to give you a ticket for headlights.

I've beat one citation via trial by written declaration and had my fine reduced in another. If you don't already know about this website check it out now!

Second of all, the citing officer may have already snipped his own nuts. I doubt he was that stupid but I'll help you determine if he was. First off, what is the CVC number on the citation...40519, 40902, etc? Secondly, on the citation the officer is required by law to list three things: time of day, road conditions, and traffic conditions. For example, on the ticket I beat the officer had written "CDL" (which means CLEAR WEATHER, DRY ROADS, LIGHT TRAFFIC) despite citing me for a 62mph in a 55mph zone. He was an f-ing hero and I wish I could have laughed in his face when the citation was overturned. Of course that's the flipside of a trial by written declaration. Good luck.

I hate getting pulled over for some bs reason. If I get pulled over and a cop wants to search my car I say no. He\she asks why you got something to hide. I say no Im using my fourth ammendment right against unreosonable search and seizure. I have not given you probable cause to search my vehicle or person. If they persist refuse again, ask for badge number and their commanding officers name implying that you will contact them and file a complaint. I have nothing against cops Im just not going to bow down and let them search me for no reason.

Obey the law (within reason), respect LEO (just as you would expect respect at your employment if earned) but never fear authority, NEVER.
