My response to the portion in red is that the law differs from state to state. I am a CCW holder (Licensed to carry a concealed firearm) and have taken the necessary training to obtain it. The law in California is that the gun is the last resort... in a fight or flight situation you MUST choose flight if you carry a concealed weapon. The ONLY time you may legally draw and SHOOT TO STOP is when flight is not an option (cornered, trapped, stuck, etc...). If flight is not an option and the assailant is armed with what could reasonably be interpreted as a "deadly weapon" then by all means you have the right to defend yourself. 
problem is you should of called the police in the first place there a reason hes driving a beater like that... he has no money or credit to get a nice car... sorry you live and learn
Definitely DON'T recommend this. I'm a competitive bodybuilder (240 ripped) with MMA training - if you 'get close to me' as mentioned above, you will get something broken - most likely your neck...
Of course, being a doctor, I would then have to wait with you for the ambulance to come, while providing cervical spine immobilization...

I've been training in martial arts for 20+ years, and am currently in school for a Masters in Physical Therapy, so you and I have some similar backgrounds. (Only you'll be getting paid a lot more than me). So I agree with you that an untrained person should NOT do this, but I just wanted to bring to light that training doesn't always equal a sure fire win. It only puts the odds in your favor.
To the original poster---I'd recommend you leave well enough alone. You're alive, your car isn't too bad off. Just avoid escalating anything because it will make your life a lot harder than it has to be. Not to mention that this guy will end up dead in an alley one day anyway.

I wholeheartedly agree with everything that is written here. My criminal justice class spelled out justifiable homocide this exact way. You must do everything within your power to get away from the situation. If all means fail and you feel that your life or someone else's life is in mortal danger then you have justification to kill that assailant. Of course this is open to interpretation and that is where a good defense lawyer could get you a not guilty verdict. It's all in how you sell it.

I think there is a new bill now that you don't even have to flee in Texas. By basic trespass on your homestead I think now means that you can drop them per this new bill.

That's pretty much everywhere... you can keep a loaded gun on your premise (your property) without so much as a license to carry. According to the castle doctrine... you are not required to retreat in your own home/business. However make sure your state does not have a "duty to retreat" law as well because that supersedes the castle doctrine.
That expandable baton is called an ASP Baton. It is considered a felony to possess one of these (at least here in California) without obtaining a license for it. The reason you need a license to carry this baton is because in the wrong hands it is a DEADLY weapon... a single strike anywhere on the head will crush the skull rendering the victim dead.

One thing to concider in a fight is that the other guy may have aids. The last thing I want is to start swapin bloody knuckles over a little damage to my car ( partially because I can do my own body and paint work ).
