I think you reacted the way most people would have. Sure, some people would have mixed it up more while others would have run away at top speed, but the bulk would just defended themselves in that "self preservation" sort of way.

Your insurance rate will not automatically go up no matter what anyone says. It may, but it's not set in stone. Personally, I think you're best bet would be to settle your insurance situation and see if you can gather more information to submit to the authorities. I'm not opposed to vengeance, but not I'm sure if that's the best for you and your situation.

Sorry that you got your *** beat, but what's the deal with insurance? Why would you be filing a claim for $300 anyway? Even if you have a $250 deductible, you only save $50 on the repair bill. I'm just not understanding the "insurance going up" part...

 

being stronger, and being able to defend yourself against an animal with no regard for the law is always a good thing.. criminals like this pray on the weak. criminals dont have respect for much of anything and dont normally use common sense (obviously). they dont hold much regard for a civilized society and therefor will 9/10 times resort to physical violence in any situation. when it comes to dealing with people like this its kill or be killed. if you personally choose to be weak and unskilled without ability to physically defend yourself in a world that isnt 100% civilized you will be the one at a disadvantage. this isnt a utopia, and there will always be a criminal element. advising someone to better themselves, and be ready for potential situations like that is never a bad thing. although i dont think carrying a gun is the right answer either. at least not for a situation like this. pulling a gun on someone isnt something you do for a warning to back someone up. if you pull the gun out you better be 100% ready to pull the trigger without hesitation or your going to be killed with it by the attacker. and a lot of people who own firearms will pull them out more so as a warning to back someone up than to stop them in their tracks and thats a mistake. you need to be smart about confronations with people like the scumbag that attacked the original poster. most people in this world will avoid confrontation which is fine, and if your not able to physically defend yourself then avoidance is best. but imho its better to be prepared as best as you can at all times so that when situations like this come up unexpectedly you can defend yourself.

My response to the portion in red is that the law differs from state to state. I am a CCW holder (Licensed to carry a concealed firearm) and have taken the necessary training to obtain it. The law in California is that the gun is the last resort... in a fight or flight situation you MUST choose flight if you carry a concealed weapon. The ONLY time you may legally draw and SHOOT TO STOP is when flight is not an option (cornered, trapped, stuck, etc...). If flight is not an option and the assailant is armed with what could reasonably be interpreted as a "deadly weapon" then by all means you have the right to defend yourself.

That expandable baton is called an ASP Baton. It is considered a felony to possess one of these (at least here in California) without obtaining a license for it. The reason you need a license to carry this baton is because in the wrong hands it is a DEADLY weapon... a single strike anywhere on the head will crush the skull rendering the victim dead.
