advice on filing c.c dispute

on Aug 16th, i purchased a "complete" motor from 4ringturncoat that included ported/polished head, Supertech valve-springs & Ti retainers (New), ARP headstuds and Buschur Racing 680cc injectors (new). here is the thread https://www.evolutionm.net/forums/sh...d.php?t=281872
i should have known something was up when Bret(4ringturncoat) kept telling me the motor was shipped and would get me the pro #, but never did, my guess is that it wasn't shipped as promised.
Fast forward to Sept 14, it FINALLY arrives. in a pm i tell Bret that the motor has arrived and i'm on my way to pick it up, he then tells me that he "just found a box of parts", including the BR injectors and starter. he offered me a refund of $125(even though the injectors are $300 new) or to ship me the "box of parts". i asked him for the parts.
here it is Oct 7th and i still am waiting for these parts. all attempts to contact Bret have been ignored, and i even went as far as getting the mods involved. Speedlimit has sent him a pm saturday morning, but i have yet to get a reply with the status of the parts that i paid for. i am also beginning to worry that he didn't have all the head work performed and i paid for a stock motor...
if i do not get an update the next time his profile shows he logged in then my next step is to file a dispute with my c.c. company (i'm over the 45 day limit for paypal by 1 wk!). my last resort is to get my lawyer involved.
what i need to know is #1, how do i begin the process of filing a dispute?
#2, how does this work considering i received the motor, it was just incomplete?
#3 anything else i can do that would help me get the parts i paid for?
any help or info would be greatly appreciated!

I would say to just go ahead and file a complaint with your cc company.I had bought some JDM EVO VIII MR taillights for my car which were supposed to be brand new.I paid the guy on 09/19/07 and I did not get the lights till this past friday.Guy kept making excuses saying that there were problems with UPS.I ended up requesting his info through ebay for a phone# and of course they did not answer.They only actually called me back because I told them that they had till the following day to respond or I was going to update my paypal claim to a dispute.Well the damn lights were obviously used.I sent the guy a message through ebay on Friday and of course he does not respond.Im giving him till tomorrow to respond via e-mail.Im not even gonna call the guy because he will just give me some lame excuse.Im gonna ask for a shipping refund due to all the problems and lack of communication on the sellers part and mis-leading descriptions.I still have time to leave him a negative feedback if all else fails.I would say to get as much info as possible that you can (any documentation,e-mails,PM's and if you can get the sellers phone# and address and turn it over to your cc company).Good luck.

i would file one. what did you pay for the motor? i hate people that fu%^ people over call the police they will take care of it that happent to me to i called the cops and he got charged with theft

yeah, i would call police and call your credit card company. you will get all your money back and keep the motor. f*** that guy, thats ashame. that is why 8 out of 10 people hesitate to buy a item off someone else because they are scared to get ripped. sorry to hear that man.

i paid $2700 + $298 for shipping. i'm not sure the cops will be able to do anything, since i received the motor...it was just missing some pieces. its really too bad, Bret seemed like a very nice guy, who knows his Evos and has a great history of selling parts...maybe he just got lazy.
i'll give my c.c company a call tomorrow and see what my options are.

heres another question, who ends up footing the bill if i win a dispute? does the c.c company just eat that as a loss?

oh yeah, looks as if Razorlab has some issues with the seller as well.

Sorry to hear about this Evo_SpeedKing.

As you know, I also had an issue with this seller.

I purchased a TRE stage 2 5spd trans from him. It was at TRE and ready to be shipped out. I payed Bret on Aug 16th for it. After about a week and a half of no status update (after he said it was ready to be shipped out as soon as he received payment) I tried sending PM's and leaving voicemails just asking for an update.

All my PM's and Voicemails where ignored. I even called Jon@TRE to see if he has had contact with him. No contact. After about 19 days of nothing I figured I just got screwed for the first time over the internet. I figured I would call and PM one last time and he finally responded saying there was some confusion on what trans was what. Even though I talked to Jon@TRE via phone 2 weeks before and he knew exactly what trans it was.

It finally ships out on sept 6th after Bret finally payed him. Jon@TRE asks me who is paying shipping as he had not received payment for shipping even though I payed Bret for shipping. Sent a PM to Bret saying he needs to pay Jon@TRE shipping. Couple days go by and I wanted to check that Jon@TRE was payed shipping so he wouldn't be out. He wasn't. So I payed Jon@TRE shipping as I didn't want another person to have to be out something in this transaction. So I payed shipping twice.

Another part of this deal was all the conversion parts for putting a 5spd in a 6spd evo. I only received the shifter base and shifter cables. Bret said the other parts "Where on the way". After getting the trans but not the rest of the conversion parts I sent Bret PM's asking about it. All went unanswered. Bret has been online many times since then because it states in your profile when the last time you where active online.

I am pretty pissed off with the whole deal. Bret seemed like a good guy over the phone and with previous transactions, but this transaction was bad. Horrible communication (none) and he didn't hold up his end of the bargain, I didn't receive all the parts promised and I had to pay shipping twice.

I really hope this transmission is really a Stage 2 5spd, fully rebuilt with zero miles on it. If not I have a very expensive paper weight.

sounds like he's lazy and once he gets your money he does everything at his own pace

Sounds like your problem was with the seller, but the transmission was shipped directly from TRE. If that's accurate, you have no worries that the transmission is EXACTLY what you bought. Jon at TRE is one of the best vendors around, and you will have received precisely what you paid for.

Indeed, I do have faith in the work that TRE does. I did verify the trans with Jon so I really shouldn't worry.

unfortunately i don't know anyone in his area or have his address. the motor was shipped from the company that he owns and the shipping receipt is somewhere...

Does the company have a website?If so you could look up the address there at least.Or maybe contact the shipping company?

Sorry to hear this. We have had a lot of dealing with Bret and never had a problem. He is VERY hard to get ahold of though, even when you are the guy selling him the parts, as in our case. I would imagine you bought the engine we built for him, he did take a long time to get it picked up and such but it seems as though he is busy with work or something else as he is just hard to contact.

I don't feel his is dishonest or a crook or anything, just seems busy and hard to reach. I really think you will work things out with him.

Just my opinion as we never had a problem with him paying or anything and we did sell him a lot of stuff.
