1) he should have slowed down, not sped up...he's been watching too many nascar related movies
2) if he was aware of the warning being out he shouldn't have been right on your butt at high speed.
I don't think he's got a snowballs chance in hell, retain a good lawyer just in case

Yeah, counter sue his @$$ because you'll be stuck in a court room and god knows whats gonna happen there. Maybe if you two bicker really bad the judge might just throw the whole case out.
#1 he did NOT maintain a safe distance or speed from u considering he KNEW the flag was up.
#2 he chose to pass a spinning car, HIS fault. he reason for not wanting to stop and get rear ended is HIS problem not yours.

I wouldn't worry to much about it. Talk to a lawyer. If the guy calls again, tell him to call your lawyer, give him the number and hang up. Talking to him can only give him ammo if it ever does go in front of a judge. That should shut him down pretty quick.
Doesn't sound like your fault, even so you might just get some legal advice anyway.
On a similar note (but kinda off-topic)
I was at the track either here or in orlando, and I saw a race between a Fc Rx7 and an Fd rx7, about 1/4 of the way down the track, probably top of 2nd or shifting to 3rd the Fd, (in the right hand lane) loses the back end and fishtails right into the other car t-boning it and slamming the Fc into the wall. From the looks of it both were totaled, and it was obviously the Fd's fault as he lost control, but what surprised me is that the little police officer in his mini van drove up to the wreck and wrote a ticket! The only thing I can imagine is that he had to establish who was at fault, but still at the track I didn't think it mattered. Not like you can call up geico and be like "yeah, so I was racing my car and I wrecked it, do I still get my full covereage?"

In the US you would not be liable because by entering the race he acknowledges that there is some risk involved in the competition. In the US if you go to a hockey game and a puck flies over the glass hitting you in the face and breaking your nose, you are the only party responsible as long as the event organizers set up safety devices that any reasonable person could think were safe enough. In your country, the story might be slightly different, and who knows if its an even greater problem across legislative lines there.
Obviously his insurance is not going to cover him and hes going to try to dick you for it. Its your responsibility to get legal council to take care of this, and unfortunately you have to pay for it. If you successfully defend yourself though you may be able to counter sue for legal fees.
Actually, a lot of insurance companies will insure your car at the track as long as it isn't a timed event. It's "Driver Improvement" .

edit: to the OP: you need a lawyer ASAP. but it looks like your easily in the clear. the warning was thrown, and he was clearly not following at a safe distance. he's trying to blame you cause he can't take personal responsibility for being an idiot.

Best bet is to check your documentation. Every insurance I've ever had specified that you were not covered if participating in organized or unorganized racing or speed contests.
And yeah, what is the speed limit on the race track? Was there a state posted sign?
Since we know the answer is "no" we know that if there was an officer crazy enough to write a ticket that it will be dropped without question. If not for speeding you can write tickets for violation of right of way, but I still doubt that.

Here is how it's going to work. He won't get a penny, and neither will you. At the track (especially when racing, not HPDE) you don't have insurance and so forth (well you might get track insurance, buyt it's going to cost you). So you're on your own, unless track officials help you resolve this matter, you can start fixing your car and have him to the same.
