Your almost positive is absolutely wrong. If the nice officer asks to look under your hood and you open it, you've given consent. If you refuse, then if the officer has probable cause to believe that the law has been broken under your hood (priming your nitrous system that he noticed), then he does not need a warrant. Absent the above, yes, he needs a warrant.
Anything the officer sees without having to move anything (like your MJ stems) are in plain sight, and do not require a warrant.
If you take it to step three, I can guarantee you that they will find something worth hauling your **** off to the pokey...

I'm almost positive that an officer is required to have a warrant to check under the hood of your car, I know they need one to look in the trunk and touch anything inside your car or make you open the doors. Unless its different in cali than in florida, but I'm pretty sure thats something that doesnt differ between states. I was pulled over once for matching the description of a suspect car which was bull cause i have the only evo in the town i was pulled over in and the cop told me that my taillight was also out, and i told him there was no way, so he said get out and check. So I do, and its not, but when i did i left the door open and he looks inside and pulls a twig off the floor that mustve gotten stuck in my track spikes and told me it looked like a marijuana stem, he then told me that that was suspicious enough to not require a warrant. I told him to screw off and that he already infringed my rights by putting his hand in my car. He let me go, but being the small town that it is, i called the police chief and let him know the whole story and the officer was put on payed leave for a couple days because there was no description of any black 4dr reported and that he had lied to me. It helps that i know the chief, but regardless it's important that you know your rights and what a cop is allowed to view on your car without a warrant, even if you have nothing to hide, you never know what one crooked cop could try to put on you, and dont be afraid to tell a cop to screw off, gently of course.

Also keep in mind the fact that you purchased the car with the parts on it wont help you out any in the courtroom, especially if you have pictures from the original for sale ad. The pictures will only prove your knowledge of the after market parts being on the car before the purchase.
So im driving to school and as soon as im about to turn into the parking lot, i see a motorcycle officer behind me im thinking ugh what did I do?
So he tells me that I have a "modified" exhaust and then makes me pop the hood and i have the intake that was there from when i bought the car. Also he tickets me for no front license plate which i was never given to by the dealership that I bought the car from. Also, the exhaust and intake were there from since when i bought the car.....
so my question is can I get the dealer to fix it or do i have to buy the stock exhaust/airbox then go get it inspected :P

1. There is no such ticket for modified intake
2. Just swap back on your stock and say thats what was on there to begin with
3. if you don't have mounts for a front plate, you are no required to have one on the front!
Nothing even to worry about man. All of it will get written off and thrown out.
