This should be the key point here.
the car is still on their lot for sale, several people have seen it there in the past couple of days. they didn't get as much as they wanted, so they tried to screw the winning bidder

well, i didn't plan on making more posts than my initial post to bring this to your attention, but i felt i should add something:

to those of you saying "this was their first time, mistakes happen"...well, yea, it may be the first time for MM, but they will pay for this mistake. There is not a "no reserve" option, there either is or there isn't. if no reserve is listed, there is none, that simple. and even an idiot could put a reserve on an auction, if you just look at the options for selling it's there, with what have a reserve does, clear as day.

mitsubishi motors corp IS in contact with MM, and is doing what they can to put an end to this. they are VERY unhappy with the dealership, and upper management is aware of this situation.

Out of that one of the members posted relevant law:

(810 ILCS 5/2-328)
Sec. 2-328. Sale by auction. (1) In a sale by auction if goods are
put up in lots each lot is the subject of a separate sale.
(2) A sale by auction is complete when the auctioneer so announces
by the fall of the hammer or in other customary manner. Where a bid is
made while the hammer is falling in acceptance of a prior bid the
auctioneer may in his discretion reopen the bidding or declare the goods
sold under the bid on which the hammer was falling.
(3) Such a sale is with reserve unless the goods are in explicit
terms put up without reserve. In an auction with reserve the auctioneer
may withdraw the goods at any time until he announces completion of the
sale. In an auction without reserve, after the auctioneer calls for bids
on an article or lot, that article or lot cannot be withdrawn unless no
bid is made within a reasonable time.
In either case a bidder may
retract his bid until the auctioneer's announcement of completion of the
sale, but a bidder retraction does not revive any previous bid.
(4) If the auctioneer knowingly receives a bid on the seller's
behalf or the seller makes or procures such a bid, and notice has not
been given that liberty for such bidding is reserved, the buyer may at
his option avoid the sale or take the goods at the price of the last
good faith bid prior to the completion of the sale. This subsection
shall not apply to any bid at a forced sale.

ahahaa.. either way, the guy who came up with the idea to sell an Evo on ebay is sure to be fired!!!!!!

i do agree that he should be fired, but still... first time mistake? if they were going to put up a disclaimer like that you'd think that they'd know what the hell they were talking about. anyway, who DOESN'T know about reserves and things on ebay, especially if you're a car dealer that's about to put a car up for auction? it's an expensive car; why would they put it up for auction WITHOUT knowing little details such as this?

they're morons...

ah well, screw dealerships that screw people over. screw em!

I bought my EVO on EBAY.........................hahahahaha I guess that dealership guy had never used ebay before, poor guy who is in charge of internet sales. He is applying at the Subaru deaership as we speak!!!!

Definitely call the news agencies. Remember the guy who tried to buy that Sequoia with coupons. The coupon did not say anything about not combining, so he collected enough to but the SUV and they refused to sell it. The news was all over it. At least it would bring reporters down and embarass the dealership. That would be a big blow to them if all of the region saw their business practices.

You wanna know what the sad thing is that all dealerships seem to be like this. They intimidate you and threaten to sue you and treat you anyway the feel. The sales guys aren't really bad I feel sorry for them the managers are like some Hussein dictator that tells them what to do and they fear losing the jobs and do it even though they know it is wrong (not all but most seem to). I just recently bought a used car for my mother in law paid cash and not even half way down the road noticed the car was running hot. I bring it back they tell me there is nothing they can do and they say if I cancel the check they will sue me and the used car manager got in my face like he wanted to fight. I tell you what it took everything in me not to put his middleaged overweight a$$ to the ground. This was a dealership I had bought my wife's brand new Protege 5, this used car, and I was talking to one of the other sales people about upgrading my wife to a Mazda 6. The used car manager told me on it was a simple thing just a valve cover gasket. WTF? I talked to the shop tech and he said it looked like a headgasket problem hence the over heating and loss of coolant. When I confronted the manager he called me several words and said to find my own way home (I was 60 miles from home without my car) and they would call me a tell me how much it was. Well to make a long story short I got a car to use off the lot got the used one fixed for free and will never see those guys again if I can help it. I talked to my friend who sells cars and she says that is there job try to scare you and intimidate you into leaving with the car and accepting what tell you. Most dealerships will tweak info to get you approved and let you leave with the car let everyone see you in it so you move heaven and hell just to keep it and they seem to pray on credit challenged people because feel they have no choice and dealers make money hand over fist at there expenses. It sucks how we all love cars soo much but have to deal with this I mean my mom likes to sew I don't see her getting hussled in the fabric store.

I had the same type of deal with my evo, bought the car and had a problem with my trade in so I told them I wanted my money back because they did Fraud me. They said no way, I called the bank and said I am not going to insure this new car and you better hope I don't hit the wall, The bank called the dealer and the dealer took the EVO back 2 days and 200 miles later. If you are smart about it you can play there games. Don't take there **** you can walk ANYTIME and there is no, this day only deals.
