Mark Mitsubishi is SO SCREWED!!!
Wow that is unethical and dishonest. But then again, eBay is the Wild West and I wouldn't buy anything over $250 off of that site.
All they had to do was set a reserve for the auction if they didn't want to sell it at $26000. Or at least just inform the guy, apologize and state that they were looking for $26000 and up and maybe give him a good deal on another Evolution. That's all they had to do, instead of lying about some fictitious auto-broker.
The funny part is that they got greedy and tried to get a couple thousand dollars more and it's ending up costing them who knows how many more potential sales.
The update:
I don't think he's taking the offer though.

"We reserve the right to cancel all existing bids and end the auction early should the item no longer be available for sale."
This is the exact language that appeared on our e-bay listing,
We did have the right to pull the vehicle from the auction, we did receive a bid on that vehicle from an outside source for $32700, you did have the right to match that bid.
But because you've seemed to become so upset over the situation, we would be willing to sell another brand new Evolution we have on the lot right now for $26995 plus all applicable fees.
You have until 8:00 pm tonight, Oct. 31st to committ to this offer. You can call John Williams at 480-425-XXXX or email us back right away.

That auction did not say "NO RESERVE" any where in it.... it was their first auction listed on ebay..... I would imagine it was an oversight from not knowing how to use ebay that they did not put a reserve in (but the auction wording did not say "no reserve" either, so...)....
so who cares...... a human error caused the problem and the winning bidder thinks he is going to get a car with $5k of extras on it for less than invoice of a stock car?
blaaaaaaaaaaaaa

they have the right to "CANCEL ALL EXISTING BIDS" and "END THE AUCTION EARLY" .... how EXACTLY does bringing up this little disclaimer help their case any? they didn't end the auction early i'm assuming, nor did they cancel any bids (except maybe in their minds)
it was their first auction on ebay....they probably did not even know how to delete bids or end the auction early.... for the first timer, it is not the easiest thing to figure out......
ahahaa.. either way, the guy who came up with the idea to sell an Evo on ebay is sure to be fired!!!!!!

...should the item no longer be available for sale
I wonder if the dealership could be sued for fraud. How can you acution an item that is no longer available for sale. Clearly, they state that if someone comes in to buy the car, they will honor that sale, and reject the auction sale.
This should be the key point here.

I had a bad experience with Mark Mitsu once and would never ever do business with them again. I tell everyone I know not to do business with them. So when I got my evo, I went somewhere else. I won't even go there for service. I do hope they get sue for fraud or something.
I think you should call the news station. Get 3 on your side. You know, where the news people goes and talks to them and everyone sees their response. That way they will get bad publicity and no one will ever go there.
