When the cars are shipped, they have an absolute minimum quantity of gas in em to cut down on shipping weight/costs. They put in just enough gas to get the car on the ship, off the ship and onto a truck to your dealer lot. So that pretty much rules out the dock workers joy riding.
Most cars are test driven a bit at the factory before being loaded onto the ship. But unless they extensively test a random sampling of cars and drive them further than others (which is possible), your miles didn't come from the factory.
I bet the dealership drove it around a bit. Or it was delivered to the wrong dealership and it was driven to your local one.
Did you see the car come off the truck?

distance from the port to the dealship. Interesting coincidence that. Easy enough to take the wheel covers off and slap them back on to fool the customer.
This was Tuttle Click Mitsi in Lake Forest if anyone wants to know.
I did a mapquest determination of the driving distance from one of the the auto compounds at the port and the dealership address. 39.8 miles. BINGO!

Go with a different car. Get one with NO MORE than 10 miles on it. I know I would. 41 is WAY too much for a brand new car. In only 5 miles someone could have done over a dozen burnouts, etc. You never know.
