Almost 2 and a half months in a body shop and still not done...Venting part 2
so pretty much the money that was giving to him by the insurance company is now spent and more and likely he will not have the funds to get the car done once started.
damn that is a crappy situation. especially if the insurance companies are not backing you up. i guess i would sit there with my springfield XD in hand and watch him work

I would just get a tow truck and tow it out, if he has no money then he isent going to work on your car even if you stare at him all day. Then i would just talk to a lawyer about what is going on.
UPDATE: So the last time I went to the body shop was about a week ago. When I was there, I had enough and told him that I will start working on the parts, since you aren't doing them fast enough. I sanded about 90% of the parts, while the body shop Owner was gettting high and drinking Natural Light beer. A few days after that, I had enough and didnt bother showing up (which I didn't have to do in the first place).
He told me the car was going to be done today and I could come inside and "help him" put it back together, which translated into, "come in on monday and put your car back together, because im a lazy ***." ... I came in today hoping everything was going to be nice and shiny. Turns out, nope. The whole right side of my car has been sanded and in the paint booth waiting for something to happen.
I got hit on the front left of my car.... The reason for him sanding all the way over there was, because he said, "Since I owe it to you, I will paint your car." My left side is all painted, right side is all sanded, along with the roof. He is leaving my bumper and trunk unpainted... Does that make any sense?
He hasn't done all bad though, I will mention that he has painted the fiberglass fenders, while they arent on my car(, my bumper, and lip. SOME PROGRESS!
All in all, some improvements have been made. Forgot to mention one other thing, He is looking for someone to put all my parts together (the parts under my hood), since he wasnt the one who put it back together...

This is a pretty depressing story. Some body shop guys are wackos and it sounds like this guy is a lazy pot smoking loser. I'd show up during business hours with a flatbed truck and hire a big guy to stand around look intimidating and just take your property back. Forget about the check and chalk it up to life lessons.
Towing my car out of there will get me nowhere. It will sit in my garage in pieces and not fully painted for a few more months or even a year. Towing it out and then suing him to get it fixed elsewhere isnt that simple. Again, taking him to court and winning the case does not solve this problem instantly.
He has no money, but the rest of the work he needs to do is general labor.

Time to report him to the BBB and get your property back. If you need to seek legal advice on how to make new arrangements at another shop, get your money back, and get it fixed. There is no reason this should have carried on like it did, and you are well within your rights to get this handled correctly and your costs covered.
I've dealt with Geico before because of some idiot with expired insurance (Geico) ramming my new Lancer GTS 2 weeks after I bought it. They sure don't like to pay out, my insurance company ended up suing them for costs. Sounds like you're going to have to take matters into your own, legal, hands though.
