Almost 2 and a half months in a body shop and still not done...Venting part 2

Hello again EvolutionM,

Well, I thought it was all going well for me after we got all my parts for my car... Well I thought wrong. Now for some of you people on here, you already know what has been going on. To make this long story short, I will sum it all up.

Approximately July 3rd, 2011, I was hit by some girl that had insurance (thank god). Her Insurance company paid me $7,000. I signed the check over to the body shop. It is now Sept 11th, and small to little amount of work has been done to my car. I go their everyday and he tells me the same exact s*** everytime. "it will be done by next week."


Now a good amount of people have told me take him to court. Thats the first problem, he has no money, so nothing would be resolved. Second, some have told me to call the cops. Calling the cops will tell you to take him to court, so nothing is still solved. Hopefully everyone who reads this shouldn't be a dumbass like me and NEVER sign over the insurance check to a body shop.

I have ran myself to exhaustion and everytime I go over there it's depressing and sad to see an Evo sitting in pieces with tons of dust all over the car.

Open to suggestion, feel free to flame and trash the thread, but not too hard.

Why not tell him you are going to go somewhere else if he can not complete the work in the time he has told you?
I know body shops are slow and you shouldn't rush one but if its been 2 months and nothing has been done I would be on there *** about getting it finished.

I go their everyday, and he has no money, so I cant take it to another shop to get it worked on. I wish it was just that simple.

Also, he is the only one that works their. All of his employees left, because he wasnt paying them (paying them under the table)

i think if you file a claim with the better business bureau they can somehow get your money back.

if someone knows more about this because i dont know that much help this guy out!

talk to a lawyer about this!

You have a contract for the work with a timeframe or anything?
2 months and no work would justify legal action I would say...

I do not have a contract for this. The adjuster had the time frame written down on the estimate for 9 days.

nothing you can do? you cant take him to court or call the cops? in your other thread, and correct me if im wrong, you stated you signed the check over to them, he turned around and used that money to do whatever and fix other peoples cars, and you also stated that he stole your antenna and used it on another car. that in itself is grand theft, not to mention insurance fraud since he is stealing their money not yours. so yes if you inform your insurance company, get a lawyer, their is something that you can do, even if he has no money. he owns that shop doesnt he? they would make him sell everything he owns to reimburse you and whoever else he is doing this to and he wouldnt have a pot left to **** in. **** people like that man, get a lawyer and put it in his *** with no vaseline before you go up there and hes already sold your car or parted it out. trust me theres plenty you can do and he will have to pay the money back, and probably end up in jail as well. you doing nothing is only hurting you and the next unsuspecting person that goes in there.

The owner of the shop is renting it out to him, so I dont know if that would make a difference. A friend of mine gave me a lawyers number to call for tomorrow.

I second this 100% The fact its been 2 months and hes still not even been somewhat productive....

Time to step up rather then thinking of your options and realizing they are endless circles... might as well get the law involved as you may not be the only person who has been played by this dude.

Regardless.. I'm sorry your car has been without its owner for 2 months

My last action before reporting him to the BBB, Calling a news station (my brother works at) called "Called For Action", and lawyering up. I want to sit in his shop all day tomorrow and watch him work on it.

OP, you may need to contact the insurance company and inform them of the situation. Call your company first. Yes, I now they didn't cut the check. Call them anyway and follow their advice.

I chose the shop because a few people who have been there said it is a good place. What I found out was that the body shop was under a different person, and that person was the one who was reputable. The guy who owns it now told me he could hook me up with what I needed and have some cash on the side for sure. I guess a dummy like me falls for something like that when you hear the money sound.

FJF- I have contacted both of the insurance companies. My insurance company, who is Geico. They said to contact the other insurance company and ask the Police. The other Insurance company said the same. They also told me, since I signed over the check to them, there is nothing they can do. If the check was written directly to the shop, it would have been another story.

About lawyering up- I am scared that I will spend so much more money for court and everything and not get anything back the way it was. I hope you guys can try and understand why I don't want to risk something like that.
