There are three routes you can take:
1)Sell as is and you take a huge loss
2)Hold onto it and get another motor (preferred IMO)
and cannibalize the rest of the engine
3)Part it out and start a track car

Its up to you. Nice thing is you have another car as a daily.

If the motor was built loose, it could conceivably have consumed enough oil to starve it over a 6-7 hour highway run. Even at non-asinine speeds. Usually, that spins bearings though.

Sorry that you have to start over with the motor, man.

That really sucks man. I bought my Evo used too, and although the seller disclosed a couple of small things, it was much rougher than he let on. I went in with my eyes open and replaced everything that had problems, but the trans, clutch, BOV, shocks all went out within 2 months of owning the car. Not much you can do about it except go in with the extra cash to cover those eventualities. It's a platform that gets beat on and when people ditch them its normally because they are in deep **** and can't fix it. The only built car I would ever consider getting is one with full documentation like a shop car. It's also why I keep every single shred of documentation on my car and everything has been done at one shop.

This could give you an option to do a different motor setup though, maybe a 2.4LR?

Check your state laws and see what Lemon Laws they have
I bought my IX off a gypsy lot. Worst mistake I made. No warranty. Threw a rod 3 weeks after I bought the car. Utah doesn't have a lemon law on used vehicles, so I had to fork out the cash to get it running again. My brother-in-law searched Craigslist and found a local guy parting his wrecked IX out and got a great deal on a motor. Had a good friend do the wrench time and saved a ton not paying labor he was, however, compensated.
Come to find out the previous owner snapped a vacuum line off the wastegate solenoid and didn't fix it, just bypassed it.
Car is running great now she's currently standing by for a mild build i'll be performing this Summer. Just got all the parts ordered.

Sorry for your loss, and good luck getting her going again. And sorry if it looks like I'm stealing your thread, I'm just sharing my story.

(1) "Consumer" means the purchaser, other than for purposes of resale, of a new motor vehicle purchased in this state, used primarily for personal, family or household purposes, a person to whom the new motor vehicle is transferred for the same purposes during the duration of an express warranty applicable to the motor vehicle and any other person entitled by the terms of the warranty to enforce the obligations of the warranty;

Lemon laws don't usually apply to used vehicle purchases so it wouldn't do him much good anyhow

Why? Maybe they did not want to make crazy power? just because it is not 30+psi does not mean it is not "fine"

Op sorry to hear man one reason i dont think i could ever buy a built engine car because you never know whos headache you are getting.

man that blows, this is why i'm very cautious when buying someone else's project, build, etc, don't know who did the work, if they knew what they were doing, threw it together, etc, hope it works out for you

3500 miles on "new block" you spent 26k & you didn't have an independent mechanic.
It's not a "as is" if he had a bill of sale for 26k.
No one gets to sell a late model car as is.
Even a person who does not sell cars for a living.
Just because it was a private sale, it's not as is.
Any being registered for use on public roads or highway must be fully operational.
Engine transmission suspension & brakes not to mention emissions.,
Most judges would agree, you should be able to make it home before it blew up.
I'd also subpoena the shop who claimed"it was ok only running 18lbs" red flag.

You have a case, how far down the rabbit hole are you willing to go.
I'd lawyer up, if he sold you a used car for 26k ill bet he's got $.

You can always fix temp & once you get it sorted out get a fully built motor.

If you got an x6 you can handle a retainer fee.

How often did you check the oil on the drive home? It can happen just like quoted. It happened to tscompusa after a long drive. New motors burn oil. Check often until you know a cars "thirst "
