It's simple, lawyer up. Insurance will try to give you the lowest amount they can for it. It will take work to value it as what you feel it's worth. I cannot tell if it's a total or not via the pics.

The damage really doesn't look that bad in the pics but insurance companies seem to be pretty quick to total out cars these days. If they try to total it out, fight them on it and make sure they give you enough money to get it fixed right. The other option is to let them total it out and then buy it back and pay for the repairs yourself. The main drawback there of course is that you would have a rebuilt/Salvage title.

How did he hit you? That's not like he was backing up.

A quick spin around the block will tell if the drivetrain is damaged. Did he run into it at speed or just judge it over? If he just pushed it over slowly I doubt there is any damage to moving parts. People bump start cars all the time.

I guarantee the insurance company is not going to replace any drive train parts if they are not obviously damaged. it sucks, but take it to a good repair shop, and don't let the insurance place dictate where you bring it to.

Damn, this is bull****, im starting to fear for my evo every time i take it out. Maybe i should just race it. Less chance of the frame getting messed up by other idiots on the road.
