My EVO was hit in december and it was repaired. I was hit by a semi driving while sitting in a right hand turn lane. He had no signals on and he was in the straight lane. The then proceeded to turn in front of me and drag his trailer accross the front of my beautiful new evo.
They did about $7,000 worth of work to it, and returned it to 97% percent condition. I will never be happy with it because it is not all original.
I am now in negotiation with the trucking company that hit me on getting a settlement. I am trying to prove that my evo will be worth less on the market now that it has a salvaged title than if it had never been wrecked. I would appreciate any information that anyone can provide to me. Go straight to the dealer where you bought the car. Act like your going to honestly trade in the vehicle, and see what they are willing to give you for your car.
STEP 2: goto KBB.com and see what they post as fair market value to a damaged vehicle.

Your car won't have a salvage title, it will just be repaired.
This is probably why you are having trouble, you don't have the facts. You are entitled to all of your losses, including those on resale. They have to put you in exactly the same place you were before the accident.
My play on this kind of thing is to just have patience. Let em do whatever they are going to do but have firm dates on which to get it done. If no get done to your satisfaction...no arguments, just ok, see you in court. We aren't going to give you a rental car...ok, see you in court. Its really quite liberating when you put the burden on them instead of taking it on yourself..

Only totalled cars that are in turn purchased from the insurance company, repaired, and reregistered for street use get a Salvage Title.
Your car was not totalled out by the insurance company. It was merely repaired. As such, you have a clean and clear title.

I really appreciate everyones input here. They offered me $1200 today for pain and suffering and deminished value and I told them that wouldnt be sufficient and they would get back to me. They were pretty open that if I could get some proof of the actual value now that they would do better on my claim.
