I had a shop called express tire install a motor for me they do that kind of thing there they purchased the motor for me from a place in Ontario calif called kar king any way the motor blew it was supposed to be a brand new block and a reman head so they looked it over and replaced it because of warranty they had so all good right? wrong about 700 miles later it blew again and they are saying that the turbo is probably depriving the engine of oil and caused oil starvation on the bottom end to me that sounds like of load of crap but I'm not an expert by any means but their saying that it could be something external to the motor that caused it too and want to see the whole car but that's like 400 to tow it up there are they trying to screw with me and not honor the warranty or should they come get it can I take them to court or is there something I can say to persuade them otherwise? Please help any info will be great in all I spent close to 9000 for the entire build I don't want to be out all that money.

That is not good news! Sorry to hear about your bad experience with them!
So you took your Evo with a blown motor to a place called 'Express Tire' and allowed them to purchase a motor for you and install it? If I looked it up correctly, their services don't even include engine installs...(per their web site www.expresstire.com). Might not even be the shop you are talking about....but that's irrelevant at this point.
I'm not trying to be negative towards you but you should have done more research on whom you were going to pay to do such a major repair to your evo.
At this point you are probably going to have to take it to another shop who can tear down your blown motor and help determine the actual cause....Make sure you are there to document and take pictures as they disassemble the motor (or ask them to do this for you in case you are not able to be there..). This part is CRITICAL! Pictures will help your cause. DO NOT believe what Express Tire is telling you with regards to the turbo starving your motor of oil until you can verify that through another shop.
Hang in there and let us know how it goes!!

I love those places. I can usually account for about 20% of my work every month to tire shops (Firestone, Sears, Tires Plus) deciding all of a sudden that they are professionals and can do actual work and not brake pads and oil changes.
There are very few cases of people working at those places that you would want touching your car in any mechanical aspect, even if it were a Cavalier, never mind an evo. While every store is different, in general they consist of people fresh out of high school with minimal to no formal training, people still in school doing that to make some money while they get their education because they "like cars", people that can't cut the mustard in a real shop environment and are reduced to that.
While there are certainly exceptions, they are few and far between. When considering a shop like this one question is usually enough to make you go elsewhere: Why would this person be working hourly for $8-12 an hour when they could be making $30-75 an hour in a real shop environment?
So uh.... yeah. Contact their corporate office and get a lawyers name... don't even need to call them usually, just present the concept to them over the phone is enough. These companies will cut a check really fast to get you out of there, as they know what will happen if they let them keep dicking with it. They roll the dice on cheap labor, and some times they crap out and they know it.
In most cases where these cars come in like this the customers will have a check for the money they spent usually minus $50-100 (no idea why) and their car released to us. In some cases they will pay to have the vehicle transported to the dealership and they pay us directly to fix their fak ups. I dislike when they do this, because many times it gives the customer the impression that they fixed their car themselves. Luckily, I'm an a$$hole. I will find some b/s reason to call the customer so they know I have it, and if the store withholds their phone number I bomb the crap out of their car with business cards. Open the glove box? Business card. Flip down your visor to block the sun? Two business cards. Open the gas door? Well maybe not that bad.
Get your financials straightened and like SS said get photos etc. Don't take the car out of their until you have some sort of commitment documented; release of the vehicle in many cases constitutes acceptance of the condition.

Ok so I talked to the motor company they are very sure it's my turbo and not their engine but the warranty is good until October so I will bite the bullet and get the car to them some how they said they would look it over take it apart and see if it is indeed my turbo if not then replace the motor again and so do you think since I'm in cali and the express tire place put a cat delete on I could tell them I'm turn them in for that? They said their part is over with unless I want them to install another motor

And the turbo doesn't hold 5qtrs of oil either.. Just a thought.

BAR would probably not like this sort of stuff. That is illegal, but you cant focus your complaint on that to them. There are various things that could have caused that motor to blow, like reusing the oil cooler. You shouldn't have taken your evo to get a motor replaced at a tire shop, BUT, the tire shop should have known better than to under take this sort of project. Get an attorney asap and see what they recommend. document everything. Not being rude, but out of all the Evo shops in your area what possessed you to take it to a TIRE shop for a engine replacement?? If that was there website above, I would still be hesitant to have them replace the tires on my wifes jeep, let alone something major like this.
