I had an unfortunate incident over the weekend in my Evo and need some advice. It's 2 AM Saturday morning and I'm merging onto a road that is undergoing construction. I'm entering in on the right, outside lane and there are cones to funnel me to the left, inside lane because the right side is about to be closed off. I cross over to the inside lane and I hear two loud Thuds. Turns out, they had just repaved the left lane leaving it at an estimated 8-12 inches higher than the right lane. The two loud thuds I hear are from me crossing over(imagine crossing over onto a curb). There was not an "uneven lanes" warning sign and because it was black on black pavement, the height difference was undectable at night. The front Advans take some serious damage and the rears are scuffed up. The height differnce was so great, that my two front Enkeis also receive some serious scuffs.
My insurance says they will pay for them minus my 500 deductible, but I feel the city or state is liable. My insurance lady recommends just having them pay for it and they will file a claim with the state. If the state pays up, then I get my deductible refunded. If they dont, I'm SOL. I had a witness in the passenger seat. I'm just wondering what my chances are because I'd rather invest that 500 in some new wheels and not file the claim at all if the chances of the state owning up is slim.

here is something interesting i just found out. the stock enkei's were only made for the evo, so you can't get it from anyone but a mitsu dealer. going rate: $520 per wheel, yes I said per wheel without the tires.

Just take some pics of the wheel and also the road. I almost had to do the same thing with my old eclipse. I requested the city to pay for it and have gotten all the info and stuff ready. By the time I was ready to file the claim, I traded the car in so didn't go thru with it.
