At that point, you have to imagine, if its even reading your key at all.....and just letting you start the car regardless, not even checking for the key.....

Yes, unless you are leaving your spare key fob in the glove box.

Oh and good luck staring it again you say> fortunatly i live in san diego and could have your evo in mexico in 15mins and stripped to the ground in 2 hours or less. now what?
So if a theif is going to go through the trouble and risk of assualting someone right when they get in their car, don't you think they'd take their keys too? Smartkey or no, getting mugged still results in a stolen car.

All cars with smart keys have this "problem". However, the guy who was able to start is car with the keys in the attic either has another key in the car he doesn't know about or needs to take his car in for service.

The keys have to be programmed into the ECU. Have you asked your dealer to make sure that only your one fob is active?

My car won't even let me lock the doors (using the button on the door handle) if a fob is inside the car...

In the manual have the session of the keyless range. I tested this problem once u can start the car as long as the key in the vehicle and once it starts u can drive it anywhere. I drove a good 40 miles without the key in the car. Once u shut off the engine you can not start the car without the key in the vehicle
