Transfer case factory overfill?

Transfer case factory overfill?

Two weeks ago my GSR (no mods, 5,500 miles, build date 1-10) started to smoke and smell like oil was hitting the exhaust. I put it on ramps and sure enough the transfer case breather had leaked a small amount of oil which was burning off the converter. I took the car into the dealer and the technician confirmed this and thought it was a "factory overfill". He drained/refilled to the correct level. I cleaned things up a bit more, including the casting pockets on top of the transfer case just behind the breather. I've been keeping an eye on it and so far no leak. Initially, I was concerned there was a potential for the gearbox to be leaking into the transfer case and causing it to overfill and burp, but the car shifts fine. I trust the tech's diagnosis, but am puzzeled. Considering the costs of failures, it seems strange that Mitshubishi would not have fluid fill proceedures worked out perfectly. Anyone else have this happen?

Yup, a local had his tcase fail and it appears to be due to factory overfill. He had an aftermarket exhaust so Mitsu voided his warranty and didn't cover it.

this is probably the 3rd incident I have read about the factory overfilled transfer case

14k on my 2010 and no problems as of now....i'll be doing the trans, transfer case and rear diff at 15k....my build date is july 09

They cant do that... PERIOD. Seriously a list needs to be made of any and all dealerships that try and play those Chicken **** games on voiding warranties. Its illegal.

I can understand if he had NO cat or a test pipe... they can and are allowed by federal law, to refuse to work on it until a cat is installed....But no dealership can VOID a warranty.. Just ask any decent lawyer or google the Federal trade commission.

There are lengthy threads on this but you're mistaken. Anything that can increase the power output can void the warranty on the entire powertrain. It was a full exhaust--CBE and drop-in air filters are the only things that Mitsu will ignore...my salesman warned me about that when I bought the car.

are these only problems on a 2010? because my car is not smoking, yet i just recently had the tcase replaced on my 2005 and ever since i have been smelling oil and having a small drip of oil in my driveway daily. My cat, and oil pan are coated in oil spray. I dont seem to have any problems tho, also the tramac, gravel, and snow options are not all lit up so i think its fine...i never thought of this as a potential problem

any time you have a fluid leak something is not right. take it back to the place that did it.

i had that same problem recently, warranty covered me luckily..gave me a new transfer case and also put in a new axle for me!

Doesn't matter. Added modifications that increased the power output of the car. Drivetrain warranty can and most of the time will be voided.

Everyone knows about the Magnuson Moss Warranty act and though it sounds good it is not reality and certainly nothing new in the Evo and modified car world

Well I just put my GSR on ramps again and the transfer case is still leaking oil. So much for the diagnosis of a "factory overfill". Disappointing...guess I'll have to take it back to the dealer again.
2010 GSR No mods. 5,500 miles.

Yup, I called a lawyer regarding a dispute with a dealership once. He wanted a $5k retainer and told me the car could be down a year or more if I waited for a settlement. Arguing about an $8k SST might be worth it but not a T-case.

I don't see what this has to do with a dispute ?? The car has NO MODS and is under warranty! I'm just trying to figure out what is going on (trying to diagnose and see if anyone else has had these problems) thanks

honestly same thing is happening to me, cleaned it up, and i see oil again.
