Possible wastegate issue?...(sorry long post)

I just picked up my x used back in sept. and its already giving me headaches. When i bought the car i was told it was stock except for a K&N panel filter and a forge recirc valve..the car ran fine. But for the past week or so it's been giving me the p1235 code and going into limp mode whenever the car gets pushed. I took the car to Double D motorsports in FL yesterday to get the DTC codes dropped from the car, because what i was told was that K&N panel filter and the Forge recirc valve that were already on the car when i bought it was causing the car to make more boost than what the stock tune allowed for. However, when we hooked up the laptop we saw that the car was already previously tuned by TTP and was running a Zchip! and they locked the map so that it couldnt be tampered with. Moreover, the previous owner removed the Zchip prior to selling the car. So they flashed the car back to a stock map, and dropped in the DTC disable codes thinking that would remedy the issue. When i took the car out for a spin, 1st and 2nd gear worked great, but when 3rd came i noticed some choppiness, then the car got a hard boost cut. I tried a roll into boost in 4th and the same thing occured. So i took it back to him and he rode along with me and logged a pull, and we realized the car was spiking 30PSI!!! so we immediately pulled over, and cut the duty cycles on the solenoid by 50%, (even though im still on the stock BCS with all the pills intact.) and went for another run. The same boost cut occured. Then we removed all the vaccum lines from the BCS and plugged them thinking it should just run 11lbs or so on wastegate pressure. More boost cut! So i removed the heatshield this morning, thinking someone tampered with the wastegate, like the DIY mod..everything looked intact, however..i still loosened the wastegate actuator arm by two turns and went for a drive. The car seems happier now, but it still gets a boost cut in third gear...Im lost....can anyone help?
