Sad story
I really like the idea of them reimbursing you for all damages and the ARC hood scoop, even though you can't buy another one
, and then getting serviced for free for life. I think that is a pretty good deal. I hate it when people try to sue the dealership for tons of money even though the car is 30k. I mean we all love our Evos and this story is F'ed up!!, but I think that is a pretty good solution. You get you car fixed for free and get thousands of dollars in saving on maintenance.
Plus if the clutch is messed up they will replace it for free as well.

LESTERH this wouldnt happen to be at the Biondi dealer? Considering I only know of 3 mitsu dealers in the PGH area and thats sendell in greensburg, southpark and biondi in monroeville. And I knew from experience that Biondi hires young kids as techs straight from wyotech

Well, I'm 99% sure I'm getting rid of the car. I was thinking about it before this, and this just pushed me over the edge. I actually called the dealership before this all happened about an offer, which they made me. IMO, a good resolution would be a much higher offer, or a swap to the new X GSR on their showroom floor - which I don't think is unreasonable.
Im on the get a lwayer and sue side. That's beyaond bad. I dont care if he lived in the middle of Fort Knox. There is no way he should have taken your car home over night. There is also no way he didnt bury his right foot on several occasions.
He still can sue them for all the damages and pain they caused him. Perhaps not for 100k but surely enough for a brand new EVO.
In all reality though, that tech is gone. They will reimburse you for the hood dmg + vent and some free work done on your car like oil change, 15k/30k etc. OR just get em to take the car in and get yourself the gtr or the m3 you wanted.

The way I see this playing out is as follows:
Offended party complains to GM.
GM apologizes, offering to pay for damages and 4-5 free oil changes.
Offended party accepts apology/free oil changes and car repairs.
Dealer finds the cheapest place to repair damages.
Repairs are completed but not up to factory standards.
Offended party takes it up the a$$.
Make sure that doesn't happen. At the very least, have the work done at a shop of your choice. Do not, under circumstances, allow the dealer to choose the repair shop, or worse yet have them repair your car at their body shop, if they have one on location.
Offended party complains to GM.
