Sad story

Just posted this on EvoXforums.: Looking for more thoughts on my next action.

So here's my lovely story for the day. Dropped my X off at Mitsubishi (not going to name dealerships yet) on Monday to have the clutch replaced. I picked it up at lunchtime today. First thing the manager says to me is, "Hey, what happened to your hood?", which of course concerned the hell out of me. He said there was some paint missing! I told him that there sure as hell wasn't any paint missing when I dropped the car off. So I go to the back to look at my car with him, and my ARC hood scoop was torn off, and the paint is missing around the air inlet. So of course I go kind of ballistic, and asked if the car was left outside overnight, which he replied, "I don't think so, well, yeah maybe it was."

So I was pissed, but they told me they'd pay for the part (which of course no one has anymore) and I figured that **** happens, so whatever.

Anyway, I get a call from one of their techs an hour later, and tells me to please call the owner and the service manager and tell them to stop yelling at him, because he'll take care of everything. I was basically like, "WTF are you talking about?" Long story short, he took my car HOME with him for the night (about a 25 minute drive) and left it at the bottom of his driveway, where apparently it was vandalized. He wanted to "make sure no CELs came on and the clutch was ok lol. So God knows what happens when a 20-something year old mechanic (who drives a Lancer with a fartcan) takes home a 400 horsepower Evo for the night with a brand new ****ing clutch in it (which needs to be broken in for 500 miles).

Anyway, my blood pressure soared, and I thought about it for about 15 minutes and called the owner of the dealership, and pretty much asked him what kind of dealership lets their employees take customers sports cars home with them for the night. He was apologetic as expected (I've spent about $70,000 over the last 3 years with them, and referred an Evo and Ralliart purchase to them, so I'm rather a preferred customer lol).

So what would you do? I assume something they've done is against the law. The worst part (besides having my baby stolen for the night) is that it seems like they tried to cover it all up. Bondo and I remembered after we left, that the manager was yelling at the tech when we walked in about something. I assume it was regarding the grand theft auto that occurred. I'm so pissed.

I'd contact an attorney to see their perspective on this. He could tell you your options.

Suck em dry! Sue them for whatever they've got. It shouldn't have happened, end of story. Call up an attorney and see what he/she has to say about it and get all options, then think on it for a day.

Contact your insurance co. Tell them what happened and let them fight it out with the dealership. Your car gets fixed ASAP.

You'll have to pay your deductible up front at most. And if what you say is true the dealer will pay it for you without question. Easy fix to the issue.

No excuse for what happened but that's your quick fix man

What's the point of having our warranties anymore if things like this keep happening...how can we trust the dealerships? This is ridiculous...I hope everything goes well and as suggested, find out if what happened was legal at all, if not......make them pay...literally, LOL!

Here ya go. From the other forum again:

That's all missing paint:

So here's another gem I noticed which requires another story. So, before I took the car into the dealership, the battery started dying. It was totally dead the last weekend, so I needed a new one. I went to Batteries Plus and bought a new one. I forgot to look at the battery terminals in the trunk before I left, so I went and bought the one they recommended which of course had backwards terminals (Positive on the left side). So I fully intended to exchange it MOnday morning for the correct one, but I was getting the battery warning light all the way, so I just went straight there so I didn't stall in the middle of the road. Batteries Plus is only about 2-3 miles from Mitsu. Anyway, I explained the situation to them, gave them the receipt to exchange it if they needed and told them to call me if they needed help. They said they'd make it work, or they'd exchange it for me since they had the receipt. They said they'd "make the vents work" (It's a vented battery, you'll notice the vents are hooked up on your stocker). Anyway, I just checked the trunk and NO ****ING VENTS ARE HOOKED UP!!!

Man, that's a horrible story. I'm surprised you didn't beat his *** already. How does a dealership let this type of stuff happen? Wow!

As a BMW technician, we are never allowed to take a customers car home for any reason. The only time this may be allowed is if the customer wanted the vehicle driven and even then it's usually driven by a foreman.

What this "mechanic" did is more then enough to get him fired. This dealer is in very big trouble.

This is what I advise you to do:

Call the general manager of the dealership. Calmly tell him that you are hoping to resolve this issue without having to contact Mitsubishi of North America or having lawyers get involved.

Ask him what they are willing to do to get you into a new replacement vehicle. If they don't make an offer that is acceptable, move on to a lawsuit and contact Mitsu NA until you get a response.
