Contract says new, Mitsubishi says used?
contract for my evo says it was new, but mitsubishi says I'm the second owner?
I currently own an evo x. For the most random reason I called the actual Mitsubishi Motors and found out that according to their records I'm the second owner of the car. This is where it gets interesting. My contract says that the car was new in multiple places, and that the car had 44 miles on it. There's also a box checked that says "this the actual mileage on the car." However, there is a pre-delivery inspection sheet that says before the inspection there was 567 miles and after 571. Mitsubishi Motors said that it is possible the original owner returned the car within 30 days.. A friend of mine who works at a dealership said that either way they still have to list the car as being used. I faxed Mitsubishi a copy of my contract and am waiting for them to call me. I am going to see an attorney next week, but from this point on I have no clue what to do. Can I get anything out of this? If the original owner returned the car in 30 days can they still claim it as new and if they tampered with the odometer what can I charge them with?

You don't honestly think a dealer would turn the miles down, do you? That's a felony that would land you in crap up to your eyeballs, not to mention the dealer would lose the franchise for doing something shady like that. The most probable scenerio is that there was a screwup made on the paperwork with the mileage listing. Regarding the new/used status of your vehicle, if a title was never issued, even if your car had 10,000 miles it is still considered new on paper.
EDIT: whoops. Yeah, what the guy above me said. 
Perhaps the car was brought back before it was fully titled. I suppose it's technically still new. My brother bought a 'new' GT-R awhile back that was driven by the owner of the dealership for 3,000 miles, but it was never titled. The odometer still read correctly however.
Are you saying you visually inspected the odometer to be 44 miles when you bought it? When I purchased my car I test drove it with 6 miles on it, brought it back with 32, and then my purchase paperwork said it had 4 miles on it at the time of delivery.

when i test drove it, started off 41 miles brought it back 44.. I figured there has to be a mix up n papaerwork, but both sheets have my vin on them. I was thinking the same thing about a dealership not turning numbers cause of what it would cost them. But the whole thing about them saying it's brand new when Mitsu says it's not is what gets me. Its a dealership in Colorado
Mitsu corporate has more than likely been misinformed. If its not and the dealer is screwing around, which I highly doubt, then you would either get a full refund and return the car or get a new one of your choice with same options.
Are VIN's sequential? Is it possible that someone hit the wrong key at Mitsu Corp? Is there a description of the car w/that VIN (i.e. WW, SSS, NAVI, whatever)?
I know that the VIN is a code for where it was assembled, chassis code, options etc, but is it possible someone mixed up, for instance a 6/9??? Just spit ballin' here
