Contract says new, Mitsubishi says used?
If it is used then you should get a discount on the price because if you brought a used car to a dealer even if it had 250 miles on it they would call it used and not pay as much. The old saying when u drive the car off the lot it loses 5 grand
I bought an s2000 a while back that was new but had a couple hundred miles on it. Didn't think much of it at the time since the deal was good. Take the car home and after driving it for a while noticed the alignment was a bit off. Take it to the dealership the next morning. They fix it no problem, but when I go to pick it up the manager comes by and tells me I have 2 more pieces of paperwork to sign. I think thats weird because I technically already own the car at this point.
Paper #1 is some kind of damage waiver. They had to disclose that a porter had damaged it while parking it one day and it had $1500 in repairs.
Paper #2 is another waiver indicating someone had "purchased" the car and taken it home only to find out later they didn't qualify for financing so they had to bring it back. Since the title never technically changed hands it was technically never sold and the dealership could technically sell it as new.
I promptly had them tear up all of the paperwork and left. As soon as I got outside I realized I now had no car and had to wait around for a friend to come pick me up. Spoke to a lawyer since I had sold another car to but that one, but they said I didn't have much of a case since they let me out of the sale of the s2000.
My bet is that's what's happening here.

Unfortunately this could be true. I hope in your case its not but as a side story when I went to buy my evo I was looking at another dealership they shipped in an evo for me with 500+ miles on it and said it was new......I said bs but what they said was it was driven from docking to the dealership that's where the miles came from but because the dealership drove it to their site it does not count on mitsu corporate as millage and they will grant you the millage on your warranty that it took to get it to the dealership. Obviously I walked away from the deal and got one with 20 miles on it but I have seen it first hand happen that cars come "new" with more than new miles on them. Be carefull some dealerships drive the cars to selling sites instead of shipping them. Thats most likely where the miles came from and they will say its new technically.......
