dealership $2800 repair
dealership $2800 repair
I have a stock used 2011gsr with 11k miles.I just bought it last month and within 1000miles noticed a oil leak. I brought it to a Mitsubishi dealership nearest me assuming it was still under factory warranty.
so they pulled it apart to replace the headgasket, but after they tore it down they found non oem headstuds.
so they can't continue any work unless I put 50% down.
I owe them $2100 in labor alone already.
Is there anything I can really do?
Did you buy it from a dealership or private seller? What makes you think it's stock (who told you that)?
If you bought from a dealership, go back to that same dealership if you can.
If it's a private seller - did he tell you it was stock? What specific wording did he use?
I just find it odd that an '11 with 11k miles would have non oem head studs.

the used car dealership sold me a extended warranty also.
ive been on the phone with him the past few days he's trying to get it settled.
but autonation is the dealership the car sits at with the block opened up.
I've had the car for a month and they've had it for 2 of the weeks.
the only thing not stock is swift springs and advan wheels.
but now I wonder what the motor has had anything done to it.

he told me if the engine grenades it woud be covered still.
now I think the previous owner just bolted everything back to return it to stock.
We should come up with a symbol we can put somewhere in the engine bay or wherever that tells others "in the know" that the car was modded.
Only us and any techs that get on here would know about it. So if someone goes back to full stock to trade in at a dealership no one else on here would accidentally pick up a ragged out hot rod while used car shopping

Dude.. this really sucks .. i had to deal with the same thing when i purchased my 2010 with 8k miles.. be prepared to do a lot of angry pointing and yelling.. cause they are going to stall as much as they can..
You said that the person who sold it to you "said" that it still has the factory warranty. That's nice, but what do you have in writing? Non-OE headstuds is a completely valid reason to deny warranty work on an engine. Assuming that the place that is working on the car is correct about the headstuds, you probably don't have a Mitsu warranty on your engine ... at least, not one that will be enforced. So it's up to the person who sold you the car and/or the third-party warranty that you bought.

For example, in Minnesota, you're required to sign a form stating that the car is As Is, or that it is Under Warranty.
If it is under warranty, the form states who is responsible for the repairs (the dealer, or the manufacturer).
See if they have one of these in your state. If not, you may have precedent for a law suit. Because I'm sure Minnesota doesn't require that for no reason. I'm sure enough people have sued dealers over this exact same issue.
Depending on what state you live in you may have signed something stating whether or not the car has a warranty or not.
