While they say it was a visual inspection, they have measurement or having 5mm or more of the pad left in the service paper work. I don't know how you would measure that with a wheel on.

Can you make an insurance claim on your auto policy? Like if you hit a pot hole or something?

That is something to consider, but I cringe at the thought of claiming that. Around here in CT if there is damage by a pot hole you can get reimbursed by the municipality.

If it is something you can get covered by your auto policy, but is someone else's fault (like the dealer), your insurance will usually go after the "at fault party." If they recover, they may even reimburse your deductible (depends on the policy).

Correct. Not as a discrete 27 Point task, but required to perform other tasks.


However, the tasks (Brake Inspection) require the shop Manual Brake Check Procedure. Make them show you the procedure. Read it out loud when it says "remove wheel and..."

I still don't see what the issue is here, there is no way they will be able to find you at fault, and even considering filing a claim with your insurance (other than to have them fight this for you) is utterly insane.

If everything you've posted is 100% fact, Mitsu is going to be fixing this for you.

Just to add another variable....what if some one removed the lugs trying to steal your wheels??

This is irrelevant because you would need some form of proof. The owner can easily argue they would have no reason to remove wheels on a car that new.

The smoking gun here is the 27 point inspection was completed, it would be very hard for Mitsu (dealer) to prove it was not their negligence that led to this on a brand new, unmodified car.

If they manual calls for them to take the wheel off at any point during the inspection, then obviously they have to put it back on and re-torque to spec.

get a lawyer, they will cave. There is no way this would make it to court. 200 miles after have the dealer inspect the car the wheel almost falls off.... i mean come on. No judge is going to find you at fault. I mean what is their argument, that after your inspection you went and loosened the lug nuts? One letter from an attorney and this will get fixed.

People actually do this. Just like they go get their oil changed then drain the oil and blow the motor up and then try to blame the lube shop. Scumbags ruin it for all of us when we have legit situations like the OP's.

Yah i could see people doing that, but under OP's circumstances there is just no motive that would make sense. The car is brand new under warranty, and he is gonna risk his and his loved ones lives for what, a few new parts?

I understand in the OP's case how it would be ludicrous to do it, but you never know man. Some people want to get out of a payment so the pull some shady ****...

If OP had gotten into an accident and was suing Mitsubishi could see them maybe trying to play that angle, but thats not the case. Like i said no judge is going to side with mitsu on this, which is why it will never make it to court. Mitsu and the dealer are just hoping to wear OP down, but one letter from an attorney and watch how fast this gets fixed.
