well i dont have the 5 spd but i will give my 2 cents. first off what kind of mods do you have on the car and how many miles are on it? i would say if you dont have any or if you do just basic things like an intake or exhaust (axle back only) you should be fine as far as fighting with the dealership with trying to get them to warranty the transmission. mitsubishi has a 10year/100,000 mile powertrain warranty and if it was caused by manufacture defects. so basicly if you drive normal and have not got aftermarket parts on the car you should be fine. if the dealership does not want to work with you try talking to the service manager. they should work with you because the dealer gets paid for warranty work from the company (I used to work at a motorcycle dealer, it should be the same) if they still dont want to do anything then call the 800 number. start looking in your owners manual and service manual you got with the car. also try and come up with receipts from services i.e. oil changes, tuneup services, etc. f you can prove you have taken care of the car and all the maintance they should cover it. also have proof that they had the car for a month. did they at least tell you whats wrong and quote you a price on fixing it? but do your research on the warranty first and know the details of it before you start raising hell over the phone and get shot down.
that is my 2 cents but if you take care of it then they should warranty it and get you back on the road. they always advertise their quality so they should back it up and help out their customers!

well i think you should be fine as far as the warranty goes. just explain the situation again and like i said if they dont want to help you call the 800
number on your service/warranty manual and talk with them and have them explain what you need to do to get you back on the road again,

Its without a doubt a different tranny. I just can't help but find it curious that several EVO X owners including one I know are having issues with 2nd gear grinding, etc. Think there have also been some posts about tranny issues on the DE, ES, GTS forum. I'm just curious if it could be a similar issue with two different tranny's. Take it to the dealer but I don't think anyone who has had an issue with the tranny has gotten resolution from mitsu.

:madLet me see if I can get some basic information correct here:
1. There are approximately 38K miles on the vehicle? Certainly well under the 100K warranty.
2. Is this timeline correct: You lost 2nd gear (September?); took the car to a dealer; they had the car for a month and replaced the throwout bearing; you got the car back and still have no 2nd gear?
3. You have done some mods, but nothing to the transmission?
When you had your car at the dealer, did they acknowledge that you have no 2nd gear? Did they acknowledge that 2nd gear still did not work when you left the dealership?
If the dealer acknowledges that 2nd gear does not work, then what excuse did they give for not fixing it?
Anyways, I think the simple answer is that if the Mitsu dealer did not fix your car, ask them why the hell not! Your car is under warranty. If they are claiming your mods void your warranty, then get a clear explanation (maybe in writing) why that is so, since you haven't messed with the transmission. Also, your mods aren't even putting any additional stress on the tranny.
If the dealer does not give you a clear answer, then look through the warranty booklet that should have come with your owner's and service manuals. There should be a number to contact Mitsubishi. Explain the problem to them and the fact that you are not getting the proper service from your local dealer.
And for God's sake, be more precise and clear with your language!
Transmission work is always iffy because it's one of the few mechanical parts that the driver interacts with directly and can wreck. If you're shifting too fast for the synchros, you could shear gears due to a sudden torque moment. A friend did this with 3rd gear in his Mazda3 because he drove it like it was a Ferrari. Good luck but by the sounds of it, if the tranny went out at 38000 miles, it's not a factory defect.
Certainly, the problem could be the result of driver error or abuse. On the other hand, it is reasonably possible that this particular transmission came from the factory with a defect (a fastener wasn't tightened properly, a part was out of spec, etc.). It can happen. There have been plenty of cars with mecahnical defects that show up in 40K miles, regardless of driver behavior.
Anyway, Mitsu warrants the drivetrain for 10 years/100,000 miles. This includes cars with manual transmissions. Any authorized Mitsubishi dealer should repair his transmission under warranty. If the dealer wants to deny FastGTS's claim, then the dealer needs to explain why; and FastGTS should get that in writing.
