I certainly could be wrong here, but it seems to me that Mitsu saying the damage was caused by a bolt that came out of place (whatever that bolt may actually be) is a gift to FastGTS. Granted, it is conceivable that rough driving could have caused the bolt to come loose. On the other hand, it is very easy for me to imagine that the bolt came loose because (1) it wasn't torqued properly during assembly or (b) the bolt or whatever it was bolted into wasn't quite to spec.

FastGTS, have you got a copy of the warranty booklet that came with the car? My car came with a "Warranty and Maintenance Manual" along with a booklet entitled "Mitsubishi Motors Dispute Resolution Process." The latter includes various phone numbers and a process for trying to resolve a warranty dispute. Have you got these booklets?

I have a feeling they just told him that to placate him. A bolt coming loose but only taking out one gear is very suspicious.

Fast needs to answer questions

1) when did you notice the problem, and did you bring it in for service immediately after?
2) if yes, did they say "yes we'll take a look", then a month later they took a look and told you "a bolt came loose and wedged itself in the transmission and destroyed second gear, so you wont have second gear, but we did replace the throwout bearing" and they just let you go?
3) Do you have reciepts and work orders from when you brought it in?

for a bolt to suddenly come loose and magically destroy your transmission soudns a little fishy to me. Honestly 75% of the facts here sound like just the runaround and it does sound like you probably drove the car very hard, missed a lot of shifts, and eventually hurt the tranny. Then you brought it into the dealership, and in usual dealership fashion they really had no idea how to fix it, and just replaced whatever it said in the book to replace. Now you have a car that still isnt fixed, and the dealership is telling you they dont know what the problem is, and you might need a new transmission.

Sound all correct?

Honestly unless you have a statement/work order/reciept from the last time you brought it in saying the dealership determined a bolt came loose and destroyed the transmission, and it says nothing about user error, you're 90% most likely going to have to pay for the fix yourself. most of the facts point to user error if what i said above is what happened.

I'm not going back to the dealer. they want me to pay $500 for them to investigate the condition of the transmission and if they find that a factory defect caused the 2nd gear grind then i'll be covered $3250 for the new transmission install. If there no factory defect is found then i'm responsible for $3250 + $500 + $1400 for a bull**** clutch install that didn't do anything for me. my only resolve is to have an expert I trust look at my transmission and tell me what i need to do. thanks for all your help i'll hopefully be up and running by next weekend.

my 4th gear is having a problem where it doesnt wana engage ill be in 3rd n go to throw it in 4th n its like theres something in the way any ideas of what this could be i do have the twm short shifter and base bushing but i dont think this would affect the gear from engaging

Putting in a short shift kit certainly could result in this problem. If the shifting problem appeared not-too-long after you installed the shifter, then that's what I would suspect. That's probably what you want to hope for, as an adjustment to the linkage would likely solve the problem.

Other possibilities that you don't want: (1) damaged synchro, or (2) damaged gear.

Are you still under warranty? If so, then you have something to think about. Such a problem would normally be covered by the drivetrain warranty. However, a dealer is likely to deny a warranty claim given your aftermarket shifter. If you want to be sneaky about it, you could reinstall your stock shifter and take it to a dealer.

blahhhhhh i really dont wana have to put the stock one back one approx how much would it cost to fix if its one of those 3 problems

Adjusting the linkage is something likely to cost anywhere from $50 to $200 depending on the mechanic. Did you install the shifter yourself? If so, then this is probably something you can do yourself. When I installed a short shift kit in my Boxster, the procedure involved the possibility of making adjustments if it didn't seem like it was shifting properly. If you paid someone to install your shifter, then bring it back to him ASAP and tell him about your problem. If he was already paid, then he should check the adjustment as a courtesy.

When did you have the shifter installed? by whom? and did your problem appear after this was done?

If you have a bad synchro or gear, then you're looking at replacing or rebuilding the transmission. I imagine a dealer would charge at least $2000. You could likely get it done for less by having an independent mechanic install a used tranny from a wreck.
