Dealer calls back 3 weeks later and says payment has to increase

Dealer calls back 3 weeks later and says payment has to increase

Hey guys,

This has nothing to do with EVOM, but I just need some insight....

My folks leased a 2005 Toyo 4runner 3 weeks ago, no trade.

The dealer calls yesterday says that the lease has to increase from 3 - 4 years and the payment has to increase.

What are my options?

Have someone look at your parent's contract...Make sure all the numbers are correct. Make sure all the signatures are there.

Then, tell the dealer, "just like there is no cooling off period for customers, the current contract is binding". If they want to cancel it, then take the truck back. Either case, they will lose money because the truck is now considered used and they are legally obligated to sell it that way.

Also, tell them you have a lawyer in the family or a family friend who is a lawyer, and tell them they better make sure what they are doing is is legal, because your lawyer will be looking at the case and preparing for a lawsuit.

That should scare them a bit and cause them to back off...

a contract is legally binding. +1 for a big bowl of *******

On the other side of the coin, could your parents tell the dealer "sorry, we don't like the monthly payment. we're gonna have to make it a 3 year loan and take $100 off the payments."? Didn't think so.

Tell them to f themselves. You signed a legal document to take ownership of said property if they forgot to carry a one or tried to get you into it by any means neccessary then thats is their bad.

Get a lawyer on retainer and have them look it over, call the car dealership and tell them that and see if their tune changes.

either fight to keep it at the current price and term, or turn it in.

Yup its signed by them and my parents.
Luckily theres no trade in they could use to taunt them with.

I will be calling them shortly.

I would prefer to give them back. I m sure I would get a better deal now on a 2005 now.

Actually if you guys read a contract it does say No COOLING OFF PERIOD for the consumer, but the dealership still has 10 days to get the loan approved as written. If they don't they would show your options and if you don't like any of them then it's up to you if you want to give the car back or whatever. Happens all the time. Remember now the contract is void because they do not have an approval as is so if you don't sign a new contract with the new numbers then you could walk away of the deal, but just remember if they can't get that deal no other can cuz most dealerships uses the same lenders especially on leases. so what most people do is renegociated the deal. And the whe bliu stated you have a lawyer in you family, come on, that won't scare them. You don't think they have bigger lawyers??? Whatever they decide to do make sure they read the paperwork because if the dealership called them then this is the final signing per lender approval. Also if the term is going to 3 to 4 years then mathmatically payments should go down unless money factor is way up there. just my 2 cents

Well, 3 weeks is longer than 10 days. I'd say (unless we have the wrong info) the dealer is SOL.

You must think very highly of dealers and the people that work there. You mean to tell me, that the dealer will NOT be losing money asking someone to come back and redo the deal and the customer says you can have your car back - thank you? The car is now USED, it has to be sold as used. If they try to sell it any other way, that is illegal.

Plus, remember, we are all tongue in cheek here. I don't honestly think that he is going to tell the dealer what I said word for word. I don't know his situation fully, so of course, we will give our first impressions and add our little side comments. The bottom line is that the consumer has rights just as the dealer does and a lawyer can find out what they are.

I have a question for you: Do you really think the dealer will bring in their lawyers for small sh** issue like this? I think they would rather just eat the money than create a bigger headache for their dealership.

In either case, his parents have the option of calling their bluff and forcing them to eat the current contract or just take the car back. They lose either way...and their reputation will be spread by this unsatisfactory deal.

Rather than taking a shot at me, why don't you just give him facts to help him...
