You need to man up and refund my money, and then relist the downpipe for sale as Xtremeboost. If you can get on here to reply to this post, you can log into paypal and refund my money. I told you I would even ship it to a new buyer for you, I think that is pretty generous all things considered.

While I can understand/believe you didnt know what it was, I still bought this from you ONLY because i wanted an ETS part.

I don't care if it was on your car or not. I only care that it was sold as ETS and I only wanted an ETS downpipe.

If the mods are on your side here there is something wrong with the Evo community. I don't care about the history of the part, where it came from, who sold it to who before it got to me. Bottom line is it was listed by the seller as ETS. I've a part of many different car communities and I know what the right thing to do is...

Well if that's the case then Englando also needs to man up and take it back from this guy. I mean he's in the same boat. He had no clue it wasn't a real ETS piece. So just have englando refund you and you send it back to him so that people aren't wasting money shipping around.

 

93gc8jdm ran it on his car and apparently didn't have any issues with it. I did... I was not sold what was advertised, bottom line.

It doesn't matter who sold who what to who before me, it matters that I bought an "ETS downpipe", from a member who advertised it as ETS, and the part was misrepresented.

 

You're absolutely correct. Explain that to Englando cause he doesn't seem to think he's at fault. He said he had fitment issues but he didn't care and just bent the line out of the way and took off the heat shield. So like I said once you give it back to 93gc8jdm, he then needs to turn around and give it back to Englando and let him deal with it. I still haven't seen him post the original for sale thread but not that it even matters.

 

I think you should file a claim with paypal and let the handle it. you will easily when the case since its not a ets dp. Whatever 93gc8jdm does with it after is not your issue. sd_lurker just seem to be on englando's case when if 93gc8jdm installed it and ran it for 5 months he was obviously happy with it and cannot return it. He just needs to resell it as a xtremeboost dp.

 

Some thoughts (random, I guess):

1) The buyer has some responsibility to verify what s/he is buying. Being an ETS part was important to you, but not important enough for you to spend a minute or two on ETS' site to see that the part for sale visually was not the same as the pictures posted by ETS?

This applies to multiple people, in this case.

2) I guess I'm failing to see why you don't just resell the part. Knowing what you paid (roughly) and what XtremeBoost DPs sell for, you should be able to recoup what was spent and move along. Leave a neutral/negative feedback on itrader if you wish since it was a misleading thread, you're not out any money, life goes on.

I mean... you're willing to ship it to a 3rd party, why not just post it and get it over with? You want him to refund you the money now, at which point he has neither the part nor the money. Can you see why he might not like that?

3) I don't like the "let Paypal handle it" mentality because that usually ends up with one person having both the money and the part.

 

I agree here about 93gc8jdm, if 93gc8jdm had not run it for 5 months and no issues and he had bought this to my attention within days of the sale I would be more than happy to take it back. It's now been used and run for 5 months and like he said he had no issues with it and was happy with it. I can't use something be happy with it and then return it for a full refund.

I think SD_lurker is after me for some reason and I don't even know the guy. SD_lurker the thread I got it from was given to Joel in a pm so get off my back about it.

The Xtremeboost DP sold for $495 plus shipping...I checked.

Are you kidding me? And wait... you are a Moderator here? It's the buyers fault if the seller sells something that's not what it really is? unfnreal. THE SAME APPLIES TO THE SELLER HERE AS WELL... Even more so, actually. the Seller IS responsible for what they sell and to make sure a part really is legit. You think it would be the buyer's fault in court?

Why do I not want to resell it?
A. Because it doesn't have good fitment, and now that its out there and known that it doesnt fit right, I don't want to sell something to another person that doesn't fit well.
B. Because its not my problem, I didn't sell a mislabeled/misadvertised part.
C. When the next buyer doesn't like the fitment, I shouldn't have to deal with it.
D. I'd ship it to the next buyer: 1. because it would probably be cheaper than shipping back to Canada. 2. It would help the guy out

I dont want to have paypal deal with it either, i want the seller to make it right and refund my money like a responsible/legitimate car enthusiast.

I don't think he's a mod.. Anyway, you should be able to get a refund from the seller, PayPal, or sell it. You will get your money back either way..

 

The entire reason we require pictures is for this reason. People would list "ETS downpipe" and link a picture from ETS' site. The buyer had no way to know what he was actually buying. You specifically said that having your car be all ETS was important; but apparently not important enough to compare the pictures 93gc8jdm posted to those on ETS' site, or even PM Michael or one of other ETS people on the board. So, yes, from the perspective of "caveat emptor" the seller needs to consider what is presented to them. It's mildly frustrating to see 3 transactions where not one of the 4 parties realized they weren't dealing with an ETS part. Anyway...

I'm trying to be pragmatic here. The reality is that you could have listed the part and probably sold it by now, recovering your money and moving on. Ideal? No. But buying a used part sight-unseen on a car forum is never ideal.

A solution - list the part for sale, including that the buyer may need to remove the heat shield and alter some things, get what you can get... split the difference with 93gc8jdm. Would that be amenable?

 

I fail to see the logic in how I, a buyer, should lose any money when a seller misrepresented a part.

Not that it matters, and I SHOULD NOT EVEN HAVE TO DEFEND MYSELF ON THIS POINT, but the extremeboost has a VERY similar design to the ETS with two differences. The bend in the dump tube, and the face of the turbo flange. With one picture, it could be pretty easy to mistake it. 93gc8jdm had one picture of the part with ETS DUMP DOWNPIPE written above it with the price... not really sure how it's my fault for not researching the bends in the dump tube.

If I was the seller, and i mistakenly sold someone a part that was not described (in this case not even the proper brand!) i would refund there money without trying to make excuses. But then again, what do I know, I'm just a stand-up guy, and have a 58 positive iTrader record.

 

It seems SD_Lurker has a vendetta against me, he is now harassing me on other forums of this situation that he has no part in nor has all the facts. Gotta love bystander members like SD_Lurker.

Regardless of who sold who this downpipe, non of that negates the fact that Joel purchased what he thought was an ETS part. Clearly isnt. Refund needs to be issued.

it appears you're a bit lost. 93gc8jdm was ALSO sold the downpipe as an ETS part. He to had no idea it wasn't. He's provided proof of englando's for sale thread. Whether 93gcjdm used it or not he was still sold a part that wasn't what it was labeled. So he as well got screwed.
