Mark Mitsubishi in Scottsdale AZ makes me ashamed to be a "Mark".

I was the legimate winner of an ebay auction earlier tonight (http://cgi.ebay.com/ebaymotors/ws/eB...tem=2438028950).

Johs Jones at Mark Mitsubishi in Scottsdale AZ emailed me after the auction had ended and informed me that the car had been sold to an autobroker for a greater amount. The auction did not end early and was not cancelled.

I consider this very unethical behavior.

Mark Mitsubishi in Scottsdale AZ apparently was awarded Mitsubishi's Diamond Chapter of Excellence. If Mitsubishi awards this dealer Diamond status, I do not know if I could ever recommend a Mitsubishi product to anyone.

I'm not sure but my brother is probably ashamed to be "Scott" for fear on having some connection to Mark Mitsubishi in SCOTTsdale AZ.

what the hell??? Each auction is not just contracting the buyer to pay, it contracts the seller to deliver, right!! I know you are not out any $$$$ here, but at least get eBay involved.

Mark, I see you haven't left any feedback yet on "marks auto" profile. You need to leave negative feedback so that no one else will make the same mistake with them and try to buy from them. This is very important.

Maybe you were lucky, $32987 is too much to pay! When I was looking back in July many MSRP EBAY auctions went unsold down south. I don't think it is hard to find MSRP, MSRP -300 or MSRP -500. I found all 3. Unless the supply has really dropped since July. A place in Utah was doing an internet deal for -500. I found a local place near Seattle offering me -300. Work by phone and get the dealers competing against each other.

don't forget that ebay contract is a legal contract and therefore you have ground for a lawsuit. i would file a claim with ebay that way they can ban him from there and prevent him from scamming other people. also, i would give them a call and then i would call the mitsubishi of america and report them of this unethical issue. this is just the same as signing a contarct to buy a car at the dealeship only to have them turn around and sell it to someone else.

He's full of ****. There is not an autobroker in their right mind that would buy an Evolution for more than invoice price. The market is no longer "hot" for this item, dealerships very rarely have them marked up over sticker, and the one that are selling at sticker are having a hard time moving them. Supply and Demand.


I know car buying like I know the back of my hand. This guy is full of ****. I bet the darn car is sitting on his lot - and you'll see it up for sale on Ebay within the next couple weeks.

See if there was a VIN listing for the vehicle on EBAY. If so, call up the dealership, ask them if that vehicle is in stock and for sale. Most likely you'll get Joe Salesman ready to make a killing of the car and tell you everything you want to hear. At that point, I would inform Ebay that the have illegally defaulted out of their sale and see what happens from there. You technically could get a lawyer, sue them, and make them sell you the car for your winning amount, but I'm just not too versed on the law in the EBay venue.

I hope you get it, and I hope your winning bid was for $20,000 so the ****** take one in the keister for lying and cheating the public.

*edit* "I have to apologize" - if he's so fricken sorry, why doesn't he sell you one of the other similarly equipped EVO's in stock?

BTW, in an auction, the bidder- makes the "offer." No contract is formed until there is an acceptance and there is some form of consideration given.

I agree.
You should email back and say you will be glad to accept another EVO in place of the sold one,
particularly if there is one in the same color.
Inform them there is no need to quivel over VIN numbers, they are all identical ...

followed your link...VIN is listed (you can do history check and the "sale" should show up - although I'm not 100% sure of this and not sure how fast this "VIN check" would list a sale that may have been done today.

it lists a red EVO in there, stock # S3451 for 39,995. I'm guessing this is your vehicle that is still in their inventory.

From the ebay seller's guidelines:

Non-Selling Seller

It is not permitted for a seller on eBay to refuse payment or delivery of an item at the end of a successful sale.

If you have sent payment and have been unable to receive your item or a refund, please refer to the eBay Buyer Protection Program for information on how to proceed. On this page you will also find instructions that will allow you to report the seller.

If a seller has refused to complete a sale and payment has not been sent or payment has been refunded, report the seller. Make sure to include a copy of the email documenting the seller's refusal to complete the sale with the full message text and complete email headers when making your report.

After receiving your report, eBay will consider the circumstances of the alleged offense. Disciplinary action may result in a formal warning, a temporary suspension, or an indefinite suspension. If a complaint cannot be proven with certainty, it is possible that no action will be taken. Due to privacy issues, eBay will be unable to discuss the result of the investigation.
PLEASE PLEASE make sure you do this. This seller is absolutely full of ****. I echo the above comment, never buy a high-ticket item from a seller with 0 or similar feedback. I won't even buy regular items from 0-feedback sellers, I prefer 5+ minimum.

Let us know how it works out. The seller MAY try to file a non-paying winner notice and request a final value fee credit, which is bad for you! Get to ebay before he does.
