Transmission failure

Transmission failure
So, today when i was leaving the parking lot (not cold start, just park for 5 mins). the transmission service required light is on and it is stucked at 2nd gear, cannot go to 3rd but able to downshift. 
so i stopped the car and use COBB AP to check the trouble code nothing appeared 
and the light was gone when i restart the car. but after i drived for another 20 mins the light was back, nothing weird happened and i can still drive and reverse. once again the light was gone after i restart the car. personally, i think its because i need to change transmission oil and filter since it is almost 40k and i donot if the last owner changed or not. Is there anyone have same problem and anyone know the reason???
