Need help BAD

Hey guys I need help really bad!! Ok heres the situation.... About 4-5 months ago. I was launching the car like a dumbass mainly slipping the clutch. Clutch went out. Had a new ACT clutch put in. After clutch was installed car didnt go into 2nd. It would pop out of 2nd gear when I release the clutch. Or if I would hold it in 2nd it would grind, but if I hold in 2nd tightly it would stay. Sooo I needed to have my tranny rebuilt got my tranny rebuilt spent roughly 2500. So got my car back for about 3 weeks. Tranny was making noise. So I took it back to the tranny shop. They repaired it, but I had to pay 350, because the 1st time it was rebuilt they didnt do it right. So I had to pay for a input shaft and a gear which was $350. They didnt charge me labor. So after the second time of getting my car back I notice some more noises. Mainly whining noises. So of course I think T-case. So I went to a mitsu dealer told them the situation and they asked what kind of fluid was put into the T-case. I go back to the tranny shop and ask what fluid was put into the t-case. He says the same kind we put into the tranny which was a synthtic oil. So I let him know thats not the right oil for t-case. He then tells me its fine because it synthetic. I didnt wanna arguy so im like ok whatever. I send out my t-case to Jon at TRE. Explained the situation to Jon. He then looks at the gears in the t-case, and he tells me it does not look like it was my fault at all, because he sees no cracks on the gears. He said it definatly looks like either the wrong fluid was put in or not enough, because the gears look burnt. Jon being the good guy that he is tells me he would right out a written statement on what caused the t-case to go bad. Incase I wanna take it to court. He's also gonna take pics and send me the old ring and pinion.

So im trying to see what action I can take towards that shop. I feel like I shouldnt be paying for someone elses mistakes. Would I have a case if I decide to take it to court? Any advice would be appreciated. Thanks alot.

Most commonly used synthetic trans gear oils e.g. Mobil 1 are GL-5 rated.
Evo transmissions use some brass alloy parts (synchronizers). And require GL-4.

GL-5 contains sulphur compounds which at higher temps break down the brass over time.

As far as the other problems you have I don't have a clue. Thought I would sare this info just in case you need it later.

I'd press it. You are right to not want to pay for someone elses mistakes. Question though... You're paying for all this because your warranty is out right? Cause my warranty bought me a whole new crate engine as well as turbo and exhaust manifold just last month. Of course my car was stock when i brought it to the shop so they HAD to warranty it.

have you told the shop what Jon found out? alot of times if you are cool and professional the shop will work with you. if not then i'd be in contact w/ the better business bureau, talking to a lawyer and here in Colorado we have this guy called "The Troubleshooter".
he has a news program & a radio show and he helps people deal w/ shady businesses that have screwed them over, alot of the time they'll do anything to fix their mistake when called out by this guy.

I have not talked to the shop yet. Im sure when I do let them know what Jon found they'll deny it. They're not going to take blame for it. I told them before when I talked to the mitsu mechanic that they put in the wrong fluid in the t-case. They then told me the mechanic was full of sh*t!
lol we also have a guy like that down here. The show is called Help Me Howard.

I would say if they dont give you your money back then you would have a good chance in court. You need proof that they used the wrong fluid or proof it was with there installation, or you stand no chance to hold up in court.

see what jon at tre has to say. Find out the quality of fluid, and what his opinion on the fluid is based on color, and thickness.

Yea he's sending it back to me now. He's also gonna write a statement on what it looks like caused the problem.

Jon at TRE will do you right. Get the t-case with the limited slip if things work out and the shop has to pay you for it. Its an amazing difference. Good luck!
