I have the same issue since I was at 22k miles. I now have 45k miles but I'm now in the process of getting a new clutch setup and may go ahead and get the shep trans

Tried to give me a sample of wrong fluid!

Update:

11-16-09

Went by Capitol Mitsubishi in San Jose CA today to collect a transmission fluid sample from my car. Sal the service adviser, directed me to a table near the front of my car and showed me what he called "the fluid that was drained from my transmission". The fluid was found to be in a red plastic container. The fluid was dirty and watery. I told Sal that there is no way that that fluid came out of my car. I took a sample of the fluid.

I then went to the back of my car where they pointed out my transmission and parts on another table. I found a pool of fluid at the bottom recess of the main gear. I grabbed the fluid with an eye dropper. The fluid I collected from the main gear of my transmission was moderately clear and had the similar viscosity of brand new motor oil.

These rip off artists tried to supply me with transmission oil that clearly did not come from my car.

I'm sending both of these samples along with a 3rd sample of brand new Red Line transmission oil to the lab.

I've already informed the Mitsubishi Corporate customer representative of the above findings.

I gave them two options: either put the car back together and give it back so I can take it somewhere else, or complete the work under warranty.

I am awaiting a call back with their decision.

Yup. I'm getting ready...

Any lawyers out there?

Any ex-Mitsubishi mechanics or Service Advisers out there willing to testify or give a statement to help my case?

Latest update:

WARRANTY DENIED

Mistsu*****i says it's based on "Driving Style", whatever that means.

I don't know how "Driving Style" can wreck a 5th gear synchro. I'd be having to do clutchless shifts into 5th gear at 120 miles an hour for some time to make the 5th gear synchro fail

This is complete BS.

My next step is to file a complaint with the National Center for Dispute Settlement.

So I will be collecting the so called "abused parts" and send them off to be inspected. I will also post pictures of the parts here for everyone to see.

I am also filing a complaint with the Better Business Bureau against Capitol Mitsubishi of San Jose for their shady behavior.

This will be a long and painful process. But in the end I hope to emerge victorious with a settlement.

And because of this, I will never buy new from Mitsubishi and I will never again take any car to a Mitsubishi Dealer for anything.

Sorry to hear all of the trouble you are going through. I know this won't help your lawsuit but this is what I did to get the fifth gear grind to go away on my 03. When I changed the transfluid I went with Pennzoil Synchromesh. It got rid of my higher rpm fifth gear grind and my rough 1st 2nd shift when the tranny is cold. I have had in my car for over 20k with no problems.

Go to another dealer. This is not an uncommon problem on the IXs. Call around and ask other dealers if they've dealt with this issue and hopefully you can find one locally that will fix it w/o hassle. There are plenty of IXs that have had the 5th gear synchro covered under warranty, so don't take this dealer's denial as the final word. They're just hoping you'll give up the fight if they tell you no or give you a hard time.

I hope this problem got resolved... cause im also on this boat. 5th gear starting to grind at high rpm and the car is at 24k miles... doesnt seem right.

My IX also had the 5th gear grind. Mitsu rebuilt my trans... they did such a horrible job a month or so later it started happening again and my shift fork was gone too i was surprised i couldn't shift to 3 rd or 4th gear it felt like the gears were not there.

Well, your first mistake was going to Capital Mitsubishi.. those ****ers are crooks. Next time do yourself a favor and go to San Rafael Mitsu, have heard nothing but good things.

Damn man they did the same thing with me here in utah with my oz rally warrenty. I quit trying and installed the clutch at a local shop. I dont know why dealers insist on us paying them a $600 dollar mark up when we can do it ourselfs for $50-$75.00

Are you retarded? You must be to make such a stupid statement. What do you do for a living? Do you do work for people for free? How well is that working out for you? No wonder dealers hate most people.

I think it is terrible what the dealer did to the OP as a denial based on "fluids" and "driving style" are bogus. Fluids could be checked without teardown of trans and driving style is not able to be monitored or proven in any fashion. They were planning on screwing him from the door hence the preauthorization for $1600. How did this ever play out?
