I agree with Izabran ^^^^
It's probably on it's second set of tranny/T-case (non-acd are easier to find) and they were too lazy to pull the ACD pump or thought about keeping it bolted-up incase they wanted to go back. That's my take.

Is the idle lopey at all or smooth as glass? What is the idle RPM? You probably have mystery cams, aswell. How hard is your clutch pedal? Might have an ACT in there, too. This is a common story around here. Nothing really wrong with any of it...just sucks that you didn't get full disclosure so you know what to expect.

Can you take a picture of your transfer case? I personally don't know all the differences visually, but someone might. There is also the fluid line going to the T-case for the pump. I don't think the '03-'04 T-cases had this. This could eliminate your fear for running without fluid to the ACD.

This is the bleed nipple for the ACD fluid on an '05 T-case (at the bottom next to the inspection plate and drain plug). If yours doesn't have this, I'm fairly certain you have an older non-acd T-case.
that bleed nipple is present i have and 05. i think i am suppose to have it because everything is there, but i will take a pick of the transfer case so that you could see. the car was in an accident i just think they was just to lazy to replace the reservoir but who know i will take pics and let you see though. also my idle is between 900 to 1200 it all depends. i am new to the eve world so i am just learning but i don't think it should idle that high should it?

You said when you purchased the car it was in an accident, it could be that it has a bad acd pump and thats why the lights are staying on. I dont know but I wouldnt personally drive it around until thats fixed. From the looks of those pics are you dissasembling the vehicle or did you buy it like that with parts disconnected like that? I just noticed that you have the intercooler pipes with no clamps, missing underbody panel, one bolt missing on the acd pump, etc. So is this how you got the car and are asking us, or are you tearing it apart fixing it up?

i love this car but i regret getting it at the moment! reason being this car is a piece of **** currently not all evo's but this one is. i traded a big turbo srt-4 for this car that was in perfect running order just needed a new clutch. i thought this car was fine just needed a new clutch also but come to find out it needs a whole new transmission. this one is cracked and is leaking fluid. it was not visible at the time of purchase but when i finally got the time to sit down and take things off this car and really examine it is totally ****ed up. i have contacted my bank and will contact my legal office tomorrow when i report to work.l damn this sux does anyone know how much i could get a tranny for if nothing happens with this car and i have to end up keeping it. i was so eager to get an evo and found this one so i just hopped in it, i totally f'ed my self on this one.

The tranny itself cost $1000 on eBay used and a little over $1000 to get it built (you might as well get it built since it's off already). Better yet, if you just drove the car home just fine, then all you need is an outter case. I would contact Shep or TRE about a new casing. Your gears could be fine so you can get those built and put it in a new case. Could save you a lot of money going this route then buying an entire tranny.
