Fraud in 2 ways:1.car was stolen. They "massaged" visible vins into vins of someone else's ( one of the unsuspecting customers) car of 50,000 miles. Make sure all the vins on the car match.
2. They had to change odometer due to change of title to salvage, but did not change the title itself (why lose money on salvege-titled car, wile you can sell it as used).
Eathr of situations are unlikely in 99% of cases, but deductive reasoning says "...why eBay if the dealer owns 10s of Brands and not strapped for cash?"

if you buy cheap you get cheap, why not buy a new one for 28 or 29k, i mean its only 6k more for a new car.

Your damages are the amount of money you are entitled to, a good measure might be the difference between the value of the car you should have received and did receive plus costs plus interest. Triple damages means you recover three times your actual damages. It is usually awarded in situations where one party, usually in a position of power, does some thing in bad faith (read: your entire experience). I am not an expert, but I think your chances of settling are good because the actions were so blatent and the penalty is so steep.

I had a similar experience down here in Australia on an Evo 4 last year. Not on ebay, but purchasing a car from a dealer 1000kms away. I test drove it at last year's F1GP in Melbourne, it was seemingly great, and when the car arrived on a truck 2 months later they had thrashed the **** out of it. I did the whole inspection/lawyer thing and eventually I returned the car to them for a full 'credit'. That is, pick another car.

I wasn't very happy with that, but short of taking legal action in another state it was the best I could get. Luckily I got a nice BMW 328i which caused me no problems, which I sold earlier this year for my Evo.

you got a solid case, you should also make them pay for the aggravation that they caused you, you can probably end up making them pay for your next MR.
