bov brok my car?
i need some input and stragegies on dealing with the dealer to get this covered. After a quick quarter mile drive 145 with 4 people (possible cause?), i get to to a dunkin dunots and the idle gets twice as loud and it starts shaking. after geting the car lifted taking off the plastice under the engine we find the radiator pipes are fine but the radiator is busted. so my buddy tows it to mitsubishi and they tell me first that "my aftermarket turbo piping hit the radiator fan and breaking it and launcing a piece into the radiator destroying it (stock turbo and intercooler piping btw). i explained to him (a mechanic at a mitsu dealer) that the car comes with turbo stock. he then said that he would get back to me on that. he called me back an hour later and said that it was all the after market parts i installed, in paticular the BOV, which hit the fan that messed up the radiator. I have an APS bov which is no where near the radiator fan, even which a high rpm hard shift it wouldnt get near it... they are trying to not even put in the claim. I am of course aware of the aftermarket part law that that if i upgrade something that could of caused the problem then i would be responsible, but a bov?!?! i had to essentially beg him to put in a claim, he said it would be no use because someone would come to check it out and deny it due to extensive mods. I did just install the greddy e-01 and am wondering if running 22 pounds of boost on 93 octane could have done that to my radiator... if anyone could throw some input on what could have caused this and how i can fight a denied claim.
my mods
APS 3" Turboback
APS Intake
APS relocated resevoir
APS bov
HKS 264i, 272e

well if i were you i wouldnt keep adding mods if you want the dealer to help you out, just wait till this issue is cleared up to keep modding...it just doesnt look good to them. Also, don't give up and call them out on all that BS you mentioned above, because that is rediculous, there's NO possible way a BOV would blow your radiator. This is the kind of stuff that makes me very angry, when you've spent 30K on one of their cars (their flagship car i might add) you STILL can't get the damn benifit of the doubt. What a shame.
im a novice but he said "that a hose in the radiator burst do to the fan"? i didnt understand i am guessing that he is talking about an internal hose but can a fan blade really do that? thanks for the quick responses

Its sounds to me like one of the blades on the radiator fan hit the BOV, breaking it off and throwing it through the radiator. Hole in radiator = coolant leaking out. Running the car at 145mph without coolant would put a hurt on the engine.
Ordinarily it would be really difficult for the dealer to prove a mod destroyed the engine (despite all the hype concerning mitsubishi voiding warranties). But if there is a hole in your radiator, and a fan blade is missing, and there is also a big scratch or nick on you BOV, you may be SOL.

Ummmmmm, Let's see ... your car is extensively modded and you're trying make a claim?? I don't quite get it .... I'm sure you understand you pay to play ... if you mod your car, you're pretty much responsible for any damage that can occur to it ... If your radiator hose and radiator is destroyed then its time to upgrade them to samco radiator hoses and a Koyo radiator ... that should be about $400 in parts ... more if you need a new radiator fan ...
StreetSurgeon: Howzit man? didn't you come here to call out all the EVOs to a drag race

I find it hard to get a good picture from either a novice car enthusiast or a
mechanic, especially if the mechanic knows he's talking to a novice car enthusiast. But, like the previous poster said, if they can prove the fan was shattered by hitting a protruding BOV and the shards punctured the radiator, then you have no case. Running around with 4 people in a car, on public roads, at 145mph, shows me you aren't terribly bright anyway, so I wouldn't totally discount the mechanic's version of what happened. The BOV, depending on the installation, could be dangerously close to the radiator fan and cause the condition in question. I wouldn't find it hard to believe a novice would not notice this problem until it was too late. I just hope your friend towed your car on 4 wheels or on a flatbed, otherwise you have one more issue to deal with (broken transfer case). I wish people would take the time to get to know their cars before bolting on parts.

I think that you should contact a legal representative and see if they can help you out here. I have read so many posts about Mitsu screwing over the EVO owners. It is time we fight back. This is a great car! Why does it have to be a Mitsu. Mitsu trully sucks in most cases but this car is so awesome that I purchased my EVO anyway.
Keep us posted on you progress!

thanks for all the info guys, its was on a flatbed, and the bov mounted sideways and despite being twice the size is about 3-4 inces from the radiator fan (which has a hubcap like plastic to prevent things just like what "happened" from happening. here is a pic of the bov installed
