It's the dealers problem. Many dealers used to pull this crap on people all the time.
You signed a loan document with terms, they are bound by the contract. If they screwed up then that is between them and Mitsu finance. You are leagally entitle to keep the vehicle under the contract you signed for financing and purchase (buyers order) with the dealer. All the dealer can do is take you to court but they will lose because you can sue them for breach of contract.

I say read all the paper work they gave you and if there is no disclaimer then keep the car.

A contract is a contract. You signed it. The car is yours I say. Too bad you don't live in Colorado. The "Make My Day" law would come in handy if that guy came to get the car.

Re-read the paper work and then keep the evo. You did sign a legal binding contract and its not YOUR fault the dealer messed up. It would be pretty handy to go and ask any of your friends who happen to be lawyers. Keep us posted on the situation.

if the car was never officially titled then the car is not used. but if enough miles are put on it then it would be considered a demo

sorry to hear this, I don't work at a dealership, but you would think that after all documents and paperwork is signed (shows the APR% given) it's the dealers fault that they didn't hold the sale until the dredit check went through. You should be able to keep the car on the terms signed. I don't know if there is a clause where they can let you take posession of the car and get it back it the credit doesn't go through. Did you already give the car back? Let me know I can call my lawyer on retainer and ask him if there is recourse or what you can do if you want. He won't charge me for just asking questions so PM me if you want info. I might just ask for my own future reference.

I know there are alota people saying keep it.. but it just seems wrong to let someone who wants to treat you that way make profit on you.. f that..

Let em have it back and ill just save another year or 2.

And as much as id like to take a dump in the backseat and give it to them, foolish to treat it abusively, and then them not give me my $$ back.

I was gonna respond to evo743, but THIS is it right here. Get 'em to eat that $2,600 in finance charges.

That blows. I'd fight it. You should'nt have to give the car back. Good Luck. Hope things work out for you!

Don't even think about letting them have it back. They ****ed up, they eat it. I mean, if you called them two days after you bought the car and said that you miscalculated how much of a monthly payment you could afford and you need to give them the car back you think they'd be so nice to let you? FUUCK THEM.
