Bad idea... your company pays if the car gets totaled. That is why all of your insurance info is collected up front. And of course you also signed a paper stating in the event of an accident or damage or theft, YOUR insurance will pay. lol. Dealerships keep stuff air tight man...

Very bad idea!! How convinient that it gets stolen when they are coming back for it. I can guarantee you the cops would be investigating that for sure.

Vehiclular habeas corpus. If you're quick and somewhat smart, they can think all they want and not be able to do anything about it. You just have to make that transition from being dedicated to committed.

Damn, all of you have EVOs and didnt read the back of the contract, like some of you said, it says that they have ten(10) days to make the deal go though and if they cant they get the car back and you get your downpayment and trade, if applicable. Its called Rescission Rights and its on the back of your contract. Anyways, that happen to me too. At the end of last year I wanted a EVO, so called the deallership my buddy got his MR cuz he got a good deal. So i talked to them over the phone and did an app., they said it was all good, so i drove they and it didnt work out (but i was trying with 0$ down). It was a 7 hr drive roundtrip. Anyways I got an EVO now, but I have a ****ty APR. But I dont care, I have an EVO. Anyways, that sucks and I hope you get an EVO soon (If you still want one)

Either way, yout must have some F*CKED up credit not to be able to get 0% with 8 freakin thousand dollars down.

5% is still pretty good, and the payments won't be MUCH more if they knock another 2k off of it. You will be sitting pretty good in that car too, in 2 years...you'll be able to sell it for well over your payoff.

I agree, it sucks....but they were trying to let you out the door that night. Just a mistake they made takin a chance. Take the deal they are offering.....but ask to have them wash taht crap once a week for 6 months or something....it'll make you feel better to negotioate something out of the deal.

Sorry to hear this dude, but I think you might have gotten off easy compared to some cases. You might think a contract is a contract but if you read the "fine prints" on the contract it states Mitsubishi has the right to modify, change... etc. There used to be this scam dealers do, they'll do whatever they can to have you sign a contract with a low APR and have you drive off with the car, and then like a week later they'll call and say that you don't really qualify for the special APR, either you come back and sign a different contract or they'll threaten to call the cops and say you stole the car. This has happened to a friend of a friend years ago, she got really screwed over by the dealership and had to hire a lawyer. The Mitsubishi dealer actaully offered you the money back, I guess they at least had some incentive in this case.

All of you talking about dropping the clutch etc... ARE STUPID.....why would you want to screw with a future evo owners ride

Getting back at the dealer does not mean f*ucking with the car. Grow up fast please.

I would think the dealer would be wanting that over a evo with 800 miles on. Just my brain on Red Bull.
+1

If you want the car, this sounds like your best bet. Get them to lower the price enough so your payments are similar over the same 5 years. 5% still rocks! It sucks man, I hate to hear that this happened. Mitsu probably has the right to take the car back, but it still makes my blood boil that they mess up like this. Good luck!

^^ agreed, i can see the post now NEW EVO 300 MI, BAD TRANNY? dont screw over a fellow brethren. if you have already acted like an a$$ to the dealer, give the car back. you dont want your dealer upset with you when/if you bring it in for warranty work or any general questions you may have. a good relationship with the dealer is definately worth a few hundred $ over 5 years. the 2k off makes your interest like 1-2% really, so its not bad at all. but if you have pissed off the dealer and you are upset with them, buy somewhere else.

You signed a loan document with terms, they are bound by the contract. If they screwed up then that is between them and Mitsu finance. You are leagally entitle to keep the vehicle under the contract you signed for financing and purchase (buyers order) with the dealer. All the dealer can do is take you to court but they will lose because you can sue them for breach of contract.

I say read all the paper work they gave you and if there is no disclaimer then keep the car.
My thoughts exactly! The dealership screwed up, you signed the paperwork and they let you drive off with the car. Fight this all the way!

Thanks for the information explaining exactly how they can get away with this, very usefull.

No, I havent been a dick to teh dealer, nor do I have any desire to **** up a future evo owners ride. Sure its an entertaining though, but completely pointless, doesnt hurt the dealer, only hurts me, and the future owner of it.

I agree, the 5% isnt a bad deal, nor is them comming down a bit on the price to help adjust to the "new deal".

Thats not the point.. the point is that it is not what it was when I committed.. and I'm not going to have any part of a system that works that way... I dont call up the dealer a few days later and say "hey, I screwed up and i cant pay $460 a month, you're going to have to get it down to 388".. this is their game, they get to set all the damn rules, and pull crap like this, fine.. doesnt mean I have to support them or allow them to make money off of me, which I'm certain they are even under this "new deal"

WOW, same thing happend to me whan i bought a conquest in 88. I got it on july 4th when all the banks were closed. Drove it to Vegas same day. 1000 miles round trip. Got the call, and told them to come and get it, they freaked at the milage and wanted new paper with a higher interest, i said no take it, THEY, the dealership, ended up co-signing the note with me!!!! I couldnt believe it. So when the turbo went out on it, they fixed it ASAP......worked out for me!!!!!

So 2 days and 320 miles on the car later *120 just to get home*, I get a call tonight, its the manager, not the salesman.. says that the deal was done after hours when mitsu financing wasnt avail to check with, and that after examining my credit history, I dont qualify for the 0% under the diamond college plan, due to "deragatory credit history".

Claims that the deal cant go through as is.. and tells me my options are
a) get a cosigner with teir 1/2 credit *cant.. *
b) rework the deal and accept 5%
c) they come get it, and give me back my $8k.

Managers being really aggressive, saying that it was to good a deal, and that with my credit I shouldnt have expected that to go through, even with $8k down. Says that other dealers are getting 2k + dealer markups and that I got it for sticker, yadda yadda.. wants to go so far as to drop $2k off the price, to reduce the note at the revised 5%..

I tell them to come get it, and gimmie my damn money back.. it is retarded to treat a paying customer this way, after they put down good money, signed a deal and drove off.

I know alot of people say I should keep it and that I have various recourse to do so.. but I dont want the damn thing now.. its a kick *** car, but someone treating me like that doesnt deserve my business.

So, if you're tempted to go get an evo, and the deal seems to good to be true withis this f'ing 0% 60 month cocktease, it prolly is.. apparently large Mitsu dealers pull shade tree used car dealer **** now.

Bye bye little evo, they are supposed to come get it tommoro morning.
beware satan.. they have that name for a reason, and apparently i forgot that.
Just tell them to honor the original deal of 0% and do not offer to accept the 5% or whatever, they have to deal with a used evo and make sure to tell them you will post the VIN in the evo website so future sale of this car will be considered used or not totally new. They will make some concessions and they will be forced to sell it to you.

WELL, FWIW it isn't the dealer doing this...its their finance company. They tried to to what they could to get you in the car and the finance company said nay. Then, they tried to eat 2k into their profits to try and help you out, as to not lose a customer. I see this as them stepping out to help you.

Well, if they're going to come get it I guess you got one hell of a test drive. Even though you're pissed, I'd try to negotiate with them at the 5% rate. If the payments (and duration of the loan) come out the same, then you're not out any money. By my estimate of the payments they would have to drop the price right at $3000 to make things even (within about $2/month). If they can't or won't do that, then let them take it back.
