You know I got run off the freeway onto the shoulder by a guy on his cell phone in an SUV just this weekend. Guy was driving well over the speed limit and weaving through traffic. Fortunately there were no curbs. If the police flake, take him to small claims court. He must pay!

the police are going to question the owner of the car and find out who was driving, but the owner isnt liable for another person's actions.

My evo got rear-ended by a truck, the driver fled the scene, no one could identify the driver, the owner or driver was never charged with a crime. It sucks but if you can't be indentified then you are free. But vigilante justice is always an option, I managed to make the truck driver sell his house and leave the state.

There should be a law in RI where I live about driving with a cell. I know every states prob like this, but everywhere I look, someones driving $hitty while on the phone. Ive almost been killed about a dozen times. My bro got sideswiped in FLA by a driver on a cell phone who kept driving all the way home. My bro called the cops and they went to the guys house where my bro followed him. The guy didnt even care about the damage to the car. (04 Evo busted up)

nothing u can proof he was on the phone anyway
he will say he wasnt on the phone and u supposed to be watching out traffic infront ,
dun think u can claim anything , one car accident is u at fault
u should have horn him before he drifted into ur lane

I'll admit that I'm still used to using cell phones while driving, but I definitely agree with these new laws that ban it. It takes sooo much attention off the road. Honestly though, I don't think these new hands free sets are any better. The driver's mind is still distracted. Hmm, but what to do?

you can prove someone was on the cell phone...there's phone records of time and duration of calls...you just have to be sure what time the accident happened.
