I would go with the one without the burn mark on the seat. That burn will only get worse over time and crap will start falling out.

I agree with that..look for the one that looks like it MAY have not been beaten on or mistreated as badly.

A local bodyshop said $300 to sand, respray, clearcoat, buff the 2 scartches. The rim? No fix.

We'll see.

In reality they are about the same. If it were a easy pick I would not have had to post the question.

Go for the one at the dealer. In my experience there is a lot of trust needed for a private party sale. When I sold my old car private party the only reason it worked was because it was my friend buying the car. He actually had to write a check to pay off the loan and the DMV wouldn't let him register the car until I signed the title over. He couldn't insure the car without registration. Of course I didn't get the title until the car was payed off. So he paid off a car that he didn't technically own. Like I said it required a lot of trust. Maybe all states aren't like this but this is what the FL DMV required.

BTW why can't I find an '05 in Florida at a dealer for less than 25. I think FL is over priced for EVO's. There are a bunch I have seen but none really close by.

go with the one from the dealer. if anything goes wrong at least you have a business to hold acountable and not an individual. also you might be able to work some body repairs ect into the deal. i also wouldnt want a car thats been smoked in.. but hey thats just me
