Another Sob Story - Evo got hit
My youngest son and I are OK , I rode to the hospital in an ambulance in a neck brace and on a back board last night, I have a slight head ache this morning and lots of pills to take. I Have not heard about the initiating car's passenger, but the driver was taken in an ambulance as well . .
. . . BUT, like the subject says, my Evo got hit last night. I was setting in a LH turn lane, signaling to turn left onto another road, when a car coming from that road shot out right into on-coming traffic, sending a good sized Jeep into my car in a split second, no time to react. It impacted my car right at the Driver's wheel and careened along the drivers side front and rear door. Mirror was tore off , lower rocker has hanging off, the driver side wheel ended up turning about 30 deg out, when the steering wheel was turned straight, doors heavily dented and creased.
In light of all that, I am pretty pleased with how the Evo protected the driver from an angled side impact in a somewhat vulnerable part of the car.
I thought I heard the police say that they estimated the car that hit me to be going about 45 at the first impact, she said she instinctively hit her brakes trying to avoid hitting me. She slowed some, but hit me with a fair amount of force, it moved the front of my car over a foot or two, which is probably why my head hurts a bit this morning.
No assessment as to the frame, chassis, or trans-axle area, but you can imagine my fears and disappointment. Now the car has officially "been hit", visions of fallen resale value and added depreciation dance in my head.
How about some voices of experience weighing in on the do's and don'ts of handling the process. Of course all the appropriate people have been contacted since the scene was attended by the police and fire dept, but I want to avoid mistakes in how to proceed with a modded car. I won't know the outcome of the adjuster's visit for a few days, etc...
What can you tell me from your experiences, etc...

Glad everyone is ok man. From your description it sounds to me like the car will be totaled out. After its totaled, buy it back and part it out perhaps?

First and Foremost you are well enough to post. Second you did nothing wrong according to your story. Just see what the insurance tells you. If they declare it totalled get the 9. If not when it get fixed you can proably get all aftermarket parts... carbon hood .. you know stuff like that.
yeah its a good thing u are ok.....srry about ur car....from the damage uve discribed about how ur car in in about a foot or two id say its totaled...thats kinda good for u. when my cousins srt4 got hit it was totaled and he was allowed to get all of the aftermarket parts off the car that he wanted...his bov, exhaust, and intake all survived...what mods did u have. oh and do u ahve any pics?

What I would do is find a good injury lawyer. My mother and sister were each involved in car accidents and the other (at fault) drivers' insurance companies were calling them every day pressuring them to give recorded statements and settle their PD and BI claims in a rush. If a former police report was file the insurance company does not need your statement in order to process a claim (I know, I work for an insurance co.) All the information they need is on the report. They will pressure you constantly for this, do not talk to the other driver's insurance!! Get a lawyer. Do NOT settle your bodily injury claim with the insurance company until you are fully recovered (may be a few months, maybe a year - depending on injuries.) A lawyer will probably advise you of this also.

If a former police report was file the insurance company does not need your statement in order to process a claim (I know, I work for an insurance co.) All the information they need is on the report. They will pressure you constantly for this, do not talk to the other driver's insurance!! Get a lawyer. Do NOT settle your bodily injury claim with the insurance company until you are fully recovered (may be a few months, maybe a year - depending on injuries.) A lawyer will probably advise you of this also.

Make sure you are compensated fairly. "Pain and suffering" is a legal term and is very subjective. Depending on your state, you may or may not be able to collect for diminished value. I'd try to get either her insurance company or yours to declare the car a total loss. You may have more leverage with your own carrier to do this if her carrier gives you the run around. If they do total it out, then be sure to get yourself down to the storage yard ASAP and pull all your mods. If the storage yard gives you any trouble, just exchange the mods with the stock parts. You could also demand to keep the salvage and sell the parts yourself.
As far as treatment goes - if you're thinking about a chiropractor, be sure to go to your PCP at least once. Make sure you follow the treatment plan as outlined. Don't have any gaps in treatment! Keep a record of all your visits and expenses. Also make sure to include any lost time from work. You'll need to provide proof for your lost earnings as well.

** Oh, and don't listen to Naucrx. You don't need an attorney. They'll charge you 33% and the insurance company is going to make the same offer to you regardless if you have an attorney or not. It's just money out of your pocket. You also need to cooperate with the adjuster's investigation. You don't need to give a "recorded statement", but you will be required to either give a verbal or written statement. They're going to need to know what happened. The adjusters will conduct their own investigation. I can tell you that police reports are not always accurate. If fact, they always have mistakes.

I'm sorry to hear about the accident, but at least you and your son are OK.
45 mph is quite a hit, hopefully insurance covers the damage and your injuries. If they write off the car, that may be better (I'm thinking frame damage). Damage might be fixable, but the car may not handle the same ever again. If the impacted section received a large enough shock, the impact could propagate to other parts of the frame.

Guys, Thanks for all the positive thoughts. Believe it or not, it helps knowing somebody "gets" the reason you are bummed about "your baby"

It does feel really bad, and your encouragement does help. I have been taliking to a lawyer froma local DSM club who gets my pain and practices in the arena of law. He is advising me off the record (for now)

Where you live? if you are at LA area, I got a very awesome lawyer for you. you will get a new EVO 8 + extras for sure lol.
anyway insurance will only covers up your car at blue book value, so a laywer is important. at least you can fight for more from that lady or your insurance.

If they have Farmers Insurance, don't think twice about it. GET A LAWYER! Farmers will try to screw you out of money on a settlement.
