Finally the follow up to my saga....

Now the follow-up...
I got completely screwed over by the police, when i called for the police report they refused to give it to me, saying i was not entitled to it because it was never filed as an official accident report. It was just a "minor accident file". Only my insurance company was entitled to the report. So that left me with no choice but to call my insurance company. I have geico insurance, and when they received the report they told me they didn't receive any of that guy's insurance information, so they have no way of going after that guy. They told me the only other way they will go after and look for that guy is if i claim through geico and then they'll foward my accident to a special department by running his plates. I felt like that was such BS, since I have to pay up front and it's not guaranteed that i'll get 100% of my money back. They sent someone to make an estimate on my car, and they said if it was over my deductible then they will go after that guy without me having to pay up front. Just my luck, the estimate came out to around $470 just $30 shy of my $500 deductible. So at that point i was really pissed off because what would be the point of buying full coverage from them. So basically, i asked them what other option i had left besides paying it up front. Eventually, the representative i talked to gave me a copy of the police report, which contains that guy's name, home address, and his vechile information, and it stated his vechile struck mine.

So in janurary i am planning on taking this to small claims court and suing him for the amount of $570 (The amount of the other estimate i got). The reason why i'm going for this amount rather than the estimate from the insurance is because in NJ if i sue for over $500 and if he doesn't pay within 60 days he'll have his liscense revoked. I just hope by mid janurary they'll still accept my case. I heard that after a certain time limit i can't file the claim. Does anyone know? It's just fustrating that i can't do anything right now, i should get back to work.. anyway .. does anyone have any other advice?

this exact same thing happened to my wife. Her crappy ins co (not GEICO, I can't remember who it was) would not go after the other person when his car hit hers- his rolled out of parking space when she was driving past and struck her door. The guy would not step up and pay ("I wasn't in the car"), her insurance company was absolutely no help, so I ended up paying the ~$500 and she changed insurance companies when her next premium was due.

Small claims sound good then I would shop for a new insurance company if GEICO is not going to back you up- that is what you pay them for.

Yeah, i can't wait to get time off to take this guy to court. I'm definately going to look for a different insurance co. I'm so tempted to drive to that guy's home and see if he has a nice car to get reparations from :lol

I wouldn't drive to his house man. He can then take YOU to court for stalking him and poking holes in your case against him. Judges never like it when someone takes the law into their own hands. Plus, what if this dude is all whacked out on drugs and is packing heat? I'd just save yourself the stress and switch insurance companies. I use USAA and they do an AWESOME job. $0 deductable on both my Evo and 350Z for full coverage plus extras as well as renters insurance (24/7 towing to the location of MY choice, etc) for $183 a month. I'd do some shoping around.

Most of the time, if you have no insured coverage...It should pay for the accident without any recourse on your insurance rate or deductible. Unfortunately that I see that accidents happen on private property all the time, and the police can't do jack about it...

Statute of Limitations is 3 years on most laws, some are longer, some are shorter. There is no way you should have a problem if you file it with in a year. I say nail the b@stard! If you win, they should give you the option of beating the crap out of him if he doesn't pay up.

go for allstate... they treat me well all the time- plus they have something new where you pay a certain amount of money a month for 6 months and if you get a ticket or you get into an accident, they won't raise your insurance

that sucks, your insurance company should help you, that's what their job is. it's called subrogation, they pay you then they seek to reclaim the money from him/his insurance company. if he is insured through geico also though good luck getting that done.

right... and since i have good grades in school, they deduct the price i would have to pay

another thing they have going is that for every year that you don't get into an accident, they lower your premium a certain amount of money... not sure what the details are though...

i hate hearing about this stuff and its a shame that you pay all this money and geico doesn't do anything about it - stupid gecko!!

that's how premiums work in general, you're good, they lower your premium. premiums come from rating risk, so if you prove to not be a risk your premium will go down. now if you stick with an insurance company for a while without re-evaluating your premium you're paying they'll have no problem letting you simply renew your old policy, keeping your old premium, even though you are less of a risk.

Yeah, I told my dad and since i paid for 6 months already he told me to get the rest of my money back and switch over to a different company now. I just couldn't believe they wouldn't do anything for me jsut because the damage is less than my deductible.
