Unsafe Speed Ticket Today.
Unsafe Speed Ticket Today.
I remember Back a while ago someone on here was a Ticket Defense Lawyer so I thought I would ask. The situation is this. 39 in a 25, I was the only one on the street didn't think I was going that fast , etc.
The Kicker is I got an "unsafe speed" ticket , not a "speeding" ticket. Whats the damn Difference? I thought Unsafe speed was 15 over? I was doing 14 over . The cop was a real jerk and I wouldn't be surprised If he did this intentionally just to be a bigger *****.
I just got this today in the morning heading to work, It was dawn and no one was out. I was headed to work. Any suggestions?

It's been my experience that if you show up to court, rather than just mail in a payment, you can get the ticket reduced. In some cases, even droped. 3 years ago, i got pulled over for exhabition (sp) driving. 10 point ticket. Went to court and plead my case. Wore a suit, used proper english, and used "Yes Sir, No Sir". The judge tore my ticket up and told me to be careful next time.

Here's a website that may be helpful -- www.motorists.org -- click on the "Fight Your Traffic Ticket" menu option on the left hand side of the home page.

This is your best bet... not worth a lawyer for this.
You don't win if the cop doesn't show up. The first court date is usually for the plea, you plea not guilty and get a trial date. If the cop can't make the trial date he has the option to ask for a rescheduled trial date. At that point you can make a big stink about you having taken off the second day from work and make a motion to dismiss. The chances of that happening are about 50/50 for a simple ticket. If it's anything major the chances are 0%.

Maybe it was unsafe because the limit was only 25, who knows though. I got pulled over once doing 65 in a 40 zone. It was the usual routine. Cop comes to my car, license, registration, do you know what I pulled you over for. So he goes back to his car for a few minutes. I am thinking about the nice fat ticket I am about to get. He comes back to the car, and the first thing out of his mouth is "You should go buy yourself a lottery ticket". I'm like what does that mean. He says "It's your lucky day because I don't have any tickets left to write out". Just thought it was funny.

the exact same thing happened to my friend. he was driving his prelude and he was speeding and he wanted to make a wide turn, so he drove across two double solid yellows into the wrong direction. This was at night in which no one was around except for a cop he didnt see. The cop pulled him over for modified exhaust, speeding, being lowered, wrong side of street, and crossing double solids. then the cop came back to him saying, "this is your lucky day, im all out of tickets"

every state is different. idaho you plea to a secretary and they give you a court date. if the cop doesn't show up, you win, period.....
problem is the cops only have 2 dates a month for court, and they schedule all his not guilty tickets on those 2 days, so each cop will have several people for that court date/time.
got off a running a red light ticket this way. cop had to stop and direct traffic for an accident/fatality on the way to court. he didn't show up. 4 of us got off.
now back to the topic at hand...
look up the exact code that you were ticketed for. if it says 15mph and he wrote it for 39/25, your off. go fight it.
find the criminal code books and start reading. I am guessing that you will find your answer there.
