Man, that bites. IIRC, trucks are responsible for anything that comes off their trucks, including tire treads, but not road debris they kick up, unless their mud flaps are missing or damaged.

Sorry to hear about it man but like dafarmer said the driver isnt responsible. My friend owns an excavating company and people flag him down all the time because he kicked up rocks, etc off the road. He's not legally responsible. He usually tells them to call the police because the police will tell them the same.

For the 10000000000 time why the F would you knowingly start your car with no oil in it.

new engine? that blows, and your insurance doesnt know if they dont cover it? wow your insurance company sucks. you should be able to claim it as a road hazzard, and the collision shouldnt go on your record because its not your fault, that was according to my friend that used to do claims and adjustments for insurance companies. she said if you ever hit anything in the middle of the road say it was moving then they cant put it as ur fault.

Did you do anything about the oil spill you created on the highway?

Some motorcyclist (like me or my wife) could be sitting somewhere talking about you in the same way you are talking about the truck driver. The guy in the truck probably didn't even know about the tire coming apart back there on his trailer. You knew about the oil.

I'm not really saying you're a bad person, just not so different from the guy driving the truck.
