Not trying to cause a concern, but can insurance companies not entertain your claim due to your car not being roadworthy due to worn tires?? Afterall that was what you say caused the accident. To be safe, you may be better off not highlighting that fact to the insurance company.
Another reason could be that the AWD system misread the inputs from the rear tires as they rotate at different speed due to being worn out. (also kill s your diff by having one side worn and other new-- actually very fast it will fry it up)
